No action is necessary to “activate” Section Three as a prerequisite to its application as law by bodies or persons whose responsibilities call for its application. The Constitution’s qualification and disqualification rules exist and possess legal force in their own right, which is what makes them applicable and enforceable by a variety of officials in a variety of contexts.

And the law review article details how, specifically, Section 3 applies to Donald Trump and others who were involved in the January 6th insurrection.

The most politically explosive application of Section Three to the events of January 6, is at the same time the most straightforward. But I do think a couple are just as clearly justified and even not really politically motivated, but are just about people being pushed into following the legal route by Trump's own stubborn actions.

Being stubborn isn’t a crime . I am not suggesting you are saying it is but what else isn’t a crime, is questioning the legitimacy of an election. Neither is calling an election official asking for his help in finding more votes .

What are 34 felony charges against Trump, and what do they reveal?

Last week, we learned Donald Trump had been charged with a crime. Now we know the former US president faces 34 counts of falsifying business records.
Although falsifying records are usually treated as lesser misdemeanours, Mr Trump is accused of committing felony offences. That denotes a more serious crime, which could include prison time if a maximum sentence is given.


The first line of the Statement of Facts, a document that accompanied the indictment, spells out the prosecution case: The defendant DONALD J. TRUMP repeatedly and fraudulently falsified New York business records to conceal criminal conduct that hid damaging information from the voting public during the 2016 presidential election.




Mr Bragg alleges that Mr Trump falsified the true nature of the payments because those payments were made in support of a crime. While hush-money payments are not by themselves illegal, spending money to help a presidential campaign but not disclosing it violates federal campaign finance law.

"The defendant orchestrated a scheme with others to influence the 2016 presidential election by identifying and purchasing negative information about him to suppress its publication and benefit the defendant's electoral prospects," the indictment's Statement of Facts asserts. "In order to execute the unlawful scheme, the participants violated election laws and made and caused false entries in the business records of various entities in New York."

In one case, a doorman who said he knew Mr Trump had a child out of wedlock received $30,000. In another, a second woman who claimed she had an an affair with Mr Trump received $150,000. Mr Trump has denied the affair.

In New York, Trump faces 34 felony counts over allegations that he falsified business records to conceal hush-money payments to a porn star. He’s also facing 40 felony counts in Florida for allegedly hoarding classified documents and obstructing the government’s efforts to retrieve them, and four counts in Washington

related to his alleged efforts to overturn the 2020 election. Most recently, the district attorney in Fulton County, Ga. charged Trump with 13 felony counts in connection to his alleged attempts to overturn the 2020 election result in that state.

A Washington grand jury voted to indict Trump on Aug. 1, 2023 after hearing months of testimony from his former aides and Administration officials, including Pence.

Trump has been charged with four crimes in the investigation, including conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstructing an official proceeding, and conspiracy against rights in connection to alleged attempts to oppress citizens in their right to vote in an election.

The videos, are you talking about j6? If so McCarthy gave them to Tucker and Fox news and when ask about that he said anyone who wanted them only had to ask. But a year later when someone else released them y'all acted like no one had ever had them or access to them. Where was your eyes and ears then? Closed and filled with peanut butter?

Yes I was referring to the J6 videos which no news organization had the balls to seek. They all simply went along with the J6 committee lies. Until one guy, Tucker decided to do journalism rather than just appease Twitter followers. The next day Chuck Schumer pleaded at a podium for FOX News to stop Tucker from showing the video from J6 which they were hiding all these months. How dare the public see it. Soon after Tucker was fired. Hmmm probably just a coincidence huh? Probably just a coincidence that Tucker's encrypted emails on Signal were somehow released. Of course I have no evidence it was the FBI behind it, but it's not much of a leap.

The Russian Collusion lie just shows the establishment media's power in influencing the election. Banding together for one common purpose to deceive their viewers is a bad look on American journalism. Its no wonder ... "US ranks last among 46 countries in trust in media".

I am staying at a friends place currently and they watch American news. I can hear the TV when I am in the pool. I find it unbelievable that ABC News are still calling what happened on J6 an insurrection. LOL.

But back to the Russian Collusion thing. The Mueller report was the 4th separate investigation into Russian collusion. FOURTH! Like the other 3, they found nothing. No presidential candidate was vetted like Trump was. CNN admitted on camera is was nonsense but still lied to its viewers for years about it.

You can pretend it was "daring to look into Russian collusion" but it wasn't that at all. It was using the media and social media to string along potential voters into believing the lie the democrats invented, with the help of the FBI, in order to discredit Trump and effect the midterms. Like almost everything in Washington, its about power.

The rape defamation case? He never raped anyone inside the changing room. He called her what she is and Trump will win the appeal.

The docs, false statement and conspiracy to destroy evidence are ridiculous.

Much like the civil defamation case, and the failure to return govt documents case, I think Trump forced the hands of his accusers by doing stuff like standing on a stage praising Putin and deriding the US intelligence services... ya know, just like a traitor working with Russia would do.

When the guy says "Eff You American Institutions" it's a bit much to complain that the responsible bodies would investigate. Imagine how stupid they would look if they had not and it turned out he was, after the way he "made it so obvious" with his words?

Anyway, only another 11 months of this dumpster fire until we find out whose strategy worked best.
