So if thay have strict checks and controls in accordance with the FSA before accepting Moneybookers as a valid payment system someone did not do the job.

Try to ask moneybookers all user data of besatke account (account history, bank account ... ) for further legal action

Hello. I am from Spain, and I am in the Bestake fraud affaire too.

This morning I sent a email to Neteller, in which I said them, that would be very interesting not to pay any money to Bestake. If there is any police activity exitous, from Costa Rica, FBI o whereever , the money has to remain in Neteller, not in Rohmoser account.

They asked me back by email that the information of Bestake account was private.

But this afternoon one boy of Neteller phoned me, and we were talking five minutes.

I explain him all the problems, not only with the express withdrawal tricky bets, but with some bettors than had not clicked the buttom, and have lost the money.

He was very kind, and I expressed him by phone than if there is any money in Neteller account belonging to bestake, please, do not pay any quantity to him.

Obviously, he said me that is a matter he is not able to decide, but the account is frozen, no money is taken away.

So, we have to wait, and I thing than everybody has to writte to Neteller and Moneybookers with than quantities stolen.

If an activity has not that much of rules, it means that operators are free to act. But it doesn't mean that judges can't punish.
It is not the government that must just behaviours, but the law system.
The existence or not of the fraud doesn't depend on laws about online betting, because the fraud exists indipendetly of the activity in whick the fraud developes. In the trial, we try to understand if there was a cheat, the damage provoked, and who had advantage of it.
Saying that here is a land without rules is not seriuos. People and companies must obey to all the giuridic and penal rules.

What's more, he said that any of us, of any nationality, can make an unique case.

Today I met with the Consul of Costa Rica in Barcelona. He said I treated in my complaint to reach the Office of Costa Rica. I expressed my doubts about the judicial system in their country because of what I had read in the forum. His reaction was sharp: there is a difference in Costa Rica to the countries of your environment and application of laws is strict there. The gave me a lawyer from San Jose to go but we can also speak with the attorney Sadzizou. This lawyer has it's own web-lawyer.com www.cr and is called Roberto Arguedas.
Another thing I did today was to put the complaint in the police station. I recommend you to do the same because it is the way he acted INTERPOL. When you put the complaint, bring all the documents and screenshots.

I'd have to agree with that. Moneybookers' communications in my experience are always in excellent English.

It could be that the original response from Moneybookers was in some other language and has been translated (poorly) for posting here though?

you have got very little chance of getting anywhere as it is, at least try to concentrate your efforts on organizations / people that can actually help you in some way.

the SFO has no jurisdiction here, and can do nothing. Moneybookers did not commit any fraud whatsoever, your complaint is not against them. Whether or not any UK users were involved is irrelevant as well, the SFO, as they say, only act against fraud committed by UK companies. This is a complete dead-end.

Try to come up with a plan here. Are you all prepared to put up money to hire a Costa Rican lawyer even though you'll likely never see a cent of either the money you pay the lawyer or your funds tied up with Betstake, is a very important question that nobody in this thread has even answered.
It's real easy (and cheap) sending e-mails to every consumer and fraud organization from here to the North Pole, but none of these will help you and they will all reply like SFO did. You really have got to do more than simply send a few e-mails to try to get something done here.

the only hope IMO would be moneybookers and neteller... i guess they still have the bestake money. what do they do? turn it over to bestake operator? freeze it?

it may be feasible to:
- request mb and nt information how much bestake funds are still on their account;
- ask mb and nt what your options are to retreive that money, what legal action would be required;
- contact independent uk lawyer to check what obligations of mb and nt are. after you have informed them about bestake fraud, they may had to have been acting to protect their clients - you, thus freezing the funds;

as for other actions, ie. writing to embassies, regulatory bodies, costarica police - i have littlee faith. i'd also only work with costarica lawyer on percentage basis, which i think they won't accept.

i suggest the above action. only if mb and nt still have the money, you may see some of it one day. good luck!

besides that there was a clear intention to harm the customers. the placement of the word whitdraw was part of the pan. clearly to deceive. the only information regarding this system was supposedly in the rules ... that nobody read. because withdraw was specifically indicated. what is the doubt?

I do not know how there are people who see criminal activity in this. or reason to complain at all possible for such agencies. we are talking about the theft of 3 million

Someone may have already mentioned this but the live help operator named 'ROHRMOSER' could very well be the owner of the site. I say this because in the terms and conditions it is clearly stated that the company also has this name. See below:

So if the live help operator is really an external company why would the alias being used correspond to the company under which the exchange was incorporated? Its possible that the sick bastard is for some crazy reason still taking complaints from the people he scammed... Perhaps someone with internet savvy can hack in to his computer using the live chat interface... I have no idea if that is even possible but would love to see this guy caught as a fellow honest gambler...

EDIT: this may have also been mentioned and it probably does not exist but the website claims "Bestake.com physical address is: Costa rica, San Jose, Guadalupe, in front of Universal Library, Campo Real Building, P.O 524-1000."
