Youre spot on, Im not a felon either, no record, whatever I have is from traffic tickets. And wow my experience is the total opposite of yours. The questions Ive been asked would blow your mind, I was pulled over earlier this year for not putting on a turn signal to get in the adjacent lane, nevermind it was late and nobody was on the road I was on, there was no car ahead or behind me for at least a half a mile, I mean nobody, made no sense to me to put the signal on so I didnt, but fine, if the law says youre supposed to do it ok. I was on my way home from work, while pulled over the cop asks me for license and insurance papers, I give, starts conversating, asks twice if I do drugs, I say no and asks why he asks, he doesnt answer, asks if he can search car, I say no, asks a 3rd time if I do drugs, I say no and I point blank tell him ya know if I had been a 60 yr old white lady you wouldnt be asking me this after pulling me over for a simple turn signal violation, well he says he would still ask, lol. Anyway he has me on the side of the road for about 25 minutes during this whole time, finally writes the ticket and I go home, was only 3 blocks from my house, nice small city I live in, no drug activity, in fact I live two blocks from this cop's precinct, but thats only one story, stuff like that has happened about 7 times, theyve even asked to search my car and after Ive said no once they still called another cop who got out with a german shepherd and did the old walk around, well thats equivalent to searching to me, oh my had I say had a bag of weed on the seat and he saw it(dont smoke weed but) no doubt Id be arrested, car impounded and given multiple tickets, that would result in quite a bit of money not to mention court costs and Id have a felony record, there would be no stomping out the weed and letting me go.

i read this article a long time ago, i think it was in The Nation or Think Progress. it was about how black kindergarteners were being disciplined more harshly than white kids for similar offenses and that the white teachers saw the black kids as older and more culpable than white kids of the same age.

they had interviews with some parents, both white and black. some studies. it was pretty interesting. really brought to life this whole public school to prison pipeline that is going on.

anyways, we might have a black president, but racism is still going strong.

Unless he smelled weed or had some other tangible way to describe a level of reasonable suspicion (more than a hunch, less than probable cause) that there were drugs in your vehicle, then to detain you further in order to have a canine officer come perform an exterior sniff of your vehicle is a violation your Fourth Amendment rights. There are many interesting cases (both state and federal) regarding canine sniffs such as how long it takes a canine officer to respond to the stop before it is considered an unreasonable amount of time. Also, the exercising of your Constitutional Rights NEVER can amount to a level of suspicion to a police officer. That is the officer cannot say, "Well, I asked if I could search jtoler's car and he refused...pretty suspicious to me!"

Your best action in a situation like this if it happens again:
Politely ask why you are being detained/stopped. If you can, record the initial stop and inform the officer that you are recording the stop. If he asks why, state it is for your safety and for integrity on the encounter. The best thing is to have the phone on the seat next to you, in a cup holder, or a front pocket. Recording with picture is nice, but sound will suffice. Document the date, time, and officer's name, and the stated reason for the stop. When he return's from running checks he has had reasonable time by law to complete the citation and therefore the stop. If the officer asks again about drug use or something unrelated to the initial stop, state no and remind him that he stopped you for a traffic citation. Ask him if you are getting a warning or a ticket and if you are free to go. If he persists in asking questions or trying to search your vehicle, remind him that the stop has been documented/recorded and he is now violating your Fourth Amendment rights. Ask for his supervising officer and tell him you will be filing a formal complaint with his station. Depending on how the stop goes, take the info down and physically go down to the police station and file a formal complaint. If you need to file a complaint, take down everyone's information (name and badge #) that you deal with and try to get as high up the chain as possible. 31. Civics/Social Studies it had a few different names but both were an intro to government and the Constitution. I remember him mostly because he was a wise-ass like myself and was enthusiastic. One of my better teachers growing up. Quite a shame they don't emphasize that anymore. Close to election time and I received a detailed book with all the candidates and propositions and a description of what they are, what they stand for, and who supports them. The local Props are literally going to effect people's every day lives in their back yards. The first parts of the post can go either way depending on the latitude of 'probable cause/reasonable suspicion' to get the K9 to come out. Exterior sniffs are one thing, a reason why the windows up/down come in to play...officers will try and get person away from the vehicle quick...to have the window down because its technically a legal opening for the dog to use. One of those games...but once the license is ran for priors/status if a drug charge pops up its easier for them to say they called the dog for 'suspicion' again on you vs the middle aged man in the mini van who was speeding and has no priors.

Your last paragraphs are spot on....most dont go through the hassle of court challenges for search/seizures because its lengthy and expensive and not worth it in minor cases. Its hilarious the way they are agued in small traffic court and circuit courts if you've ever heard them....guy gets pulled over for speeding and it led to weed being found in the car...he will personally argue or have a cheap attorney claim all these massive violations of undue searches and fruits of the stop that led to the drugs....the the local judge asks the simple question 'how fast were you going as the reason he stopped you initially' and the reply can be 58 in a 55...judge says well its over 55 so yes you were speeding which validates the stop that led to the finding, next case" so its not as if they end up drawn out expensive cases over a $150 fine and a day in county.

I know all about that "free air sniff" trust me, my calling it searching is because its a dog, a dog trained to sniff out drugs, doesnt really need to be inside my car to pick up a hit, sure if Id had something stuffed away securely covered in mustard then probably he wouldnt pick up on it, bottom line I didnt agree to the search yet instead he held me on the side of the road an extra 25 minutes while he called a dog out and to walk around my car, if he didnt think that dog could pick up a hit by simply walking outside my car he never would have did it. Bottom line, profiling and prejudice. This was a simple speeding ticket that time, why are you trying to search my car on a speeding ticket and calling dogs out, only one reason. This happened when I was like 23, back in late 90's so a long time ago, could happen again, but he sneaky with it, it was about 1 am in the morning, I was in another county I knew nothing about after seeing a girl, so Im pulled over on the highway, I just wanted to get the ticket and go home, in that situation I wouldnt be saying Im recording, that late so far from home, no other cars on the highway, pitch black, raining hard, didnt just give ticket for speeding, said since its raining Im gonna give you a ticket for wreckless driving also,I could just as well get my arse kicked by those cops, but if any out of line questions ever happened again Ive thought about asking the cop if he's mic'ed if not then Ill start recording with phone, stuff like this doesnt really happen anymore to me, have thought about getting cam in car but just dont see myself ever going through all that.

I'd have sent a hail of bullets in your direction, made sure you were near death, taken out my unregistered sat night special i keep in my patrol car, pop off a round from where you lay back into the direction of my "wheels of death and justice," and clasped your hand around it as you lay there gargling, dying from drowning from the blood filling your lungs..... i take driving drunk and weed possession seriously.

the second you "get an attitude" with a cop (his perception, not reality--and anyone who records a stop is immediately considered by the cop to have an attitude problem), the stop is going to start heading downhill..... watch porky's ..... the scene where the cop starts bashing taillights, headlights, and thereafter pointing out the "no headlights/taillights" violations to get a feel for the cops' attitudes at this point...... he/they-- as by now he will have called for backup due to your obvious attitude problem -- will look for any reason to take you down at that point.... be very careful if you employ el nino's tactics..... you may ultimately beat the rap b/c of them, but you will probably wind up spending a night in jail...... AND, DEFINITELY DO NOT USE THEM IF YOU HAVE HAD ANYTHING TO DRINK OR SMOKE OR POP that has you anyway impaired. And el nino's tactics are best utilized on sunday's on your way to or from church.... other than those times, any cop who pulls over some wanna be lawyer is apt to bust your ass on anything he can possibly come up with, particularly the ol "you're interfering with an official police investigation" line.....
