Apparently the guy just had a bag of Skittles on him. NYPD are currently tearing that rail off and hauling it's ass downtown. Likely be arrested and jail time. Jesse Jackson has proclaimed that rail to be racist and is demanding justice.

Ironically, that rail is produced by Zimmerman Steel from Austria. Gotta love it!
