The case for charging Trump with manslaughter

The next Jan. 6 committee hearing — a prime-time finale after seven previous hearings — is expected to focus even more intently on what was happening inside the White House during the insurrection. I will be listening for evidence of a crime that has gone largely undiscussed: manslaughter.

Five people diedin the Jan. 6 attack. Officer Brian Sicknick sustained a fatal stroke a day after rioters sprayed him with a chemical irritant. Air Force veteran Ashli Babbitt was shot by police when she tried to climb through a window and enter the House chamber. A Georgia woman, Rosanne Boyland, was crushed by fellow rioters as they pushed their way against the police outside a Capitol door. Kevin Greeson, an Alabama man, died of a heart attack in a sea of Trump supporters on the sidewalk west of the building. Benjamin Philips of Pennsylvania died of a stroke during the assault on the Capitol.

The loss of life was predictable in light of the size of the mob, their emotional state and their use of force.

The loss of life was predictable in light of the size of the mob, their emotional state and their use of force. We recently learned from Cassidy Hutchinson’s testimony another key fact —

    then-President
Donald Trump knew that the crowd was armed, adding to the risk that someone would be killed.

According to Hutchinson, this risk was also foreseeable to White House counsel Pat Cipollone, who urged White House chief of staff Mark Meadows to persuade Trump to take action to stop it.

According to Hutchinson, Cipollone told Meadows: “Something needs to be done or people are going to die and the blood’s going to be on your f---ing hands.

This is getting out of control.”

Under federal law, involuntary manslaughter occurs when a person commits an act on federal property without due care that it might produce death.

To establish a criminal case of manslaughter against Trump, prosecutors would need to prove each of the elements of that offense beyond a reasonable doubt: an act, committed without due care, that caused death.

First, did Trump commit an act that could constitute the actus reus for manslaughter? His statements at the Ellipse in which he urged the crowd to march to the Capitol could be an act that constitutes this element.

Recent evidence that this was not a “metaphorical” statement, but rather a coordinated plan, would make the statement even more egregious because it would mean that Trump had time to reflect on the potential deadly consequences of his actions.

But First Amendment concerns about political speech could create sticky legal issues. So instead, prosecutors could focus on acts of criminal omission.

Unlike most members of the public who have no duty to take action to prevent a crime, a president has a constitutional duty to “take care that the laws be faithfully executed.” The president also serves as commander in chief of the armed forces. On Jan. 6, when Trump was alerted that the situation at the Capitol was getting “out of control,” he had a duty to call in the National Guard to quell the violence. According to Joint Chiefs of Staff Chairman Gen. Mark Milley, Trump did not do so. Nor did he call any other government agency to intervene.

On Tuesday, we heard testimony from Cipollone that Trump could have gone to the press briefing room and made a statement on camera asking the mob to disperse, and that Trump refused.
Trump also had a direct communication channel in the form of Twitter, but instead of posting a tweet asking the crowd to go home, Trump rekindled the flames by tweeting that Pence lacked the “courage” to toss out the election results.

It was not until the 187th minute of the riot that Trump put out a video-recorded statement asking the mob to go home. I believe his three hours of inaction will amount to an omission necessary to prove that first element of manslaughter.

It's been an on going Trump witch hunt since 2016. Time and time again Trump is proven innocent and all the Trump hating Dems get butt hurt again and have egg on their face. Jan 6th no different.

Now Joe Biden and Hillary Clinton are straight up swamp material. Career politicians that really lie off their asses. Crooked Hillary was a mess and Joe Biden is a mental mess.

Trump still has a fully functional brain. Best President in decades. 2024! MAGA!

Trump if elected again will bring back low crime, great economy, reverse inflation, make America energy independent again, build up our military and finally secure our borders. World peace through strength also restored..

              Who doesn't want that?

Unless you are going to charge all of the Democratic politicians who called for unrest in the streets responsible for the dozens of deaths that took place during the 2020 summer of BLM riots, then this theory about Trump getting arrested for manslaughter is asinine.

100 percent truth. Trump told supporters to peacefully protest at the capital. Democrats encouraged people to protest when they knew the protesters were violent and destroying property.

So you despise a man who gave up billions of dollars to become President and put America and it's citizens first. Why exactly? Do you prefer the way America is now under Joe Biden? You can hate Trump all you want but have to admit America was doing much better under his leadership.

The men led the first wave through police barricades, then body-surfed to a Capitol entrance to cause more mayhem

Two New York state men who led a mob that overwhelmed police at the perimeter of the Capitol on Jan. 6, 2021 — then bodysurfed over the top of the crowd at a building entrance and pepper-sprayed officers — were both sentenced Friday to 44 months in prison.

Cody Mattice, 29, of Greece, N.Y., and James Mault, 30, of Brockport, N.Y., both wept as they stood before Chief U.S. District Judge Beryl A. Howell and asked for leniency, apologizing for their actions and saying they hoped to return soon to their families and young children. But Howell noted that prosecutors had already cut them a reasonable deal by dropping charges that could have led to far more prison time, and she imposed the sentences requested by the government. Only four other Jan. 6 defendants have been sentenced to longer prison terms.

Text messages obtained by the FBI showed that Mattice and Mault planned for violence on Jan. 6, initially expecting resistance from antifa. They texted family members during the mayhem, and then congratulated each other in the days after the riot, which temporarily halted the certification of the presidential election.

Trump wants to announce he's running sooner than later because he thinks, perhaps correctly, that it will make it less likely he's charged.

You are correct there was no insurrection

more than 840 people have been arrested for storming the U.S. Capitol building on Jan. 6, 2021, with charges ranging from obstruction of an official proceeding to assault. But 17 months after the attempted insurrection, a significant number of rioters are still awaiting their sentencing.
Only around a quarter of those arrested—185 individuals—have received criminal sentences, while the rest are waiting for their trials or haven’t yet reached plea agreements. According to the U.S. Attorney’s Office for the District of Columbia, 80 defendants were sentenced to periods of incarceration, with longer prison terms for those who engaged in violence or threats. So far, the median prison sentence for the Jan. 6 rioters is 45 days. An additional 57 rioters have been sentenced to periods of home detention, while most sentences have included fines, community service and probation for low-level offenses like illegally parading or demonstrating in the Capitol, which is a misdemeanor.

Do you prefer the way America is now under Joe Biden? You can hate Trump all you want but have to admit America was doing much better under his leadership.
Trump never put anyone but himself first and never gave up anything. He would con people out of money, example telling the people of Geargia to send money to him /his campaign to get senators in their state elected and never spent any in Georgia for that purpose

He been treated badly they need to leave him alone he is just little. He didn't know being POTUS would come with criticism so leave him alone poor thing

How do you libtards explain Ray Epps and even AOC saying the Capitol police let people in. So, you're going to ignore the obvious Biden shenanigans with their ties to China and Ukraine, the laptop and all the shady dealings. Also all the RECENT revelations about Hilary cooking up the whole collusion thing and NEVER MIND THE BENGHAZI DEBACLE and the blatant classified email crimes. No, let's try and get Trump FOR THE TWELFTH TIME. I suspect Trump is probably kind of a buffoon in person but I'm never gonna meet him and he CLEARLY did a decent job as President.
