#6Yes, I do about a dozen of these a month for my biz. What you first do is throw EVERYTHING into your claim to Jack it to the max, $5k in most states. There will be a 50% chance other side doesn't show at hearing, which is a summary judgment for you, otherwise tgere will be a mediator at the court first who will whiddle down your claim to the original amount likely, and you will probably accept payments to avoid the judge.Comment -

In reality... in small claims court... a judge can give you the judgement in your favor. He can't enforce it. Enforcing a judge's decision is an entirely different process.... and variables to the equation. For example:
1. If you get a judgement against someone who doesn't care about their credit report... or their credit is already shi#$y.... they won't care to pay you. You'll have to find personal property that they own... and/or will eventually pay off and put a lien on it. Not only that... but something that won't lose value. Usually a car has importance... but loses value. A boat has importance... typically won't lose major value. Real estate has value... but some people won't ever move. No need to sell. So if you're dealing with someone who could careless about their credit... Could take years before you get your money. When you place a lien on someone's property... their credit score could drop around 50 points.
2. If you get a judgement against someone who cares about their credit score... and history... they will pay you rather quickly. They don't want liens against their personal property etc.
But yeah... the law sucks. The judge gives you the verdict in your favor. But a judge will not collect for you. There is no imprisonment for someone who doesn't pay a lawsuit.Comment -
