#4Depending on where the servers are located, the act of making a wager on the Internet maybe legal. However the act of getting paid is a whole different story.Comment -

So yes, online gaming is legal, just not with American money withen the United States. Until this War on Terror Bull Sh*t is over, I don't see it happening on a National scale any time soon.Comment -

It's not just a matter of making it legal, there are a ton of regulations, tax issues, and state laws that have to be complied with as well. It's going to take a while.Comment -

Oh no...not forever...Look for Harry Reid's casino operating constituents to legally takeover the online poker world. I would expect the rake to be horrible in the future and of course all income earned will be taxed. What is true is that the hey day of online poker is gone and the reality of the game being just another government income stream will start.Comment -

#13That is a moot point. How can you bet the ponies if you have no track in your state, no OTB and you are unable to bet online? It's illegal in quite a few states. Offshore is the only option.Last edited by Easy-Rider 66; 06-03-13, 12:55 PM.Comment -

#14I counted 10 states that have no tracks on the restricted list for Xpressbet(Legal online wagering site) Then there are several states that allow wagering on the horses, but not through a legal ADW'S like Xpressbet.Comment -

#15The current regulatory landscape in the United States is so muddled and unclear it is difficult to determine if online sports betting is even illegal (unless you live in one of the eight states or so that specifically prohibits it). So many issues: federal preemption (federal versus state laws), outdated (Wire Act) and inapplicable laws (PASPA which only applies to state run institutions and UIGEA which prohibits financial institutions from funding Internet gambling accounts but does not address legality or define "unlawful Internet gaming"), equal protection/constitutional issues (how can feds legalize in Nevada while prohibiting in New Jersey?), jurisdictional issues over Internet sportsbooks, dormant commerce clause violations on an international scale (US allows bets from foreigners on horse races but we won't let our citizens gamble overseas with you -- see WTO dispute), commercial speech doctrine, freedom of contract, various and sometimes inconsistent court decisions, DOJ letter of intent not to prosecute individual bettors, etc, etc, etc...
It's all a big joke. I don't think anyone that has properly analyzed the whole situation can say whether online sports betting is illegal (or legal). It is a big mess and I do not expect any definitive answers soon.
