Lawyer: No proof nurse raped Arizona patient who had baby

Nathan Sutherland, a licensed practical nurse, has been arrested and charged with one count of sexual assault and one count of vulnerable adult abuse, according to court records.

“We owed this arrest to the victim. We owed this arrest to the newest member of our community — that innocent baby,” Phoenix Police Chief Jeri Williams said.

“There’s no direct evidence that Mr. Sutherland has committed these acts,” Defense attorney David Gregan said.

because obviously there's evidence he fathered a child if his dna matches the baby's.... question is whether the az rape statute covers conduct where the alleged victim is incapable of giving consent, and not just conduct against the victim's will....

lawyer's a dumbass to make any statement at all if the best he can say is "no evidence" when there's a dna match (I'd hoped for his sake he was relying on the definition of rape under az law, and was stating that his client's conduct fell outside the definition, such that he could state "there is no evidence that my client raped")... instead, it just sounds like he's a f'n idiot.....

lawyer by far isn't doing his best, as doing his best would have been to state "no comment" to any such questions, and not make idiotic statements to the press that undercut his and his client's credibility -- particularly his own.......

There was a case in New York, Law and Order did an episode based on it, where 6 teens had a gangbang with a 16 yr old retard.

The kids all said they did it, the girl said she wated it and enjoyed it. The parents of the girl brought the case to the DA for prosecution.

The jury ruled the retarded girl could not provide consent therefore all 6 are guilty of rape. The judge immediately set aside the jury verdict and set the kids free citing the girls testimony that she 1- asked them to do it and 2- admitted receiving pleasure from it

Now, in this case, it'll be interesting to factor in the 1- level of incapacitation of the woman and 2- the legal and cultural needs of the child

If the woman if not incapacitated it is not out of the realm of possibility that defense could show she enjoyed the act by physically showing that there are no signs of rape (bleeding, forced penetration, etc) and if the father shows care and financial support for kid there is a good chance that this works as the lawyer suggests
