    Omaha store ordered to pay shoplifter $750K
    OMAHA, Neb. (AP) -- An Omaha jury has ordered a discount store to pay a man convicted of shoplifting from it $750,000 for injuries he received from a store employee who confronted him about the stolen items.
    A Douglas County jury on Friday found in favor of Richard "Dave" Moore, 59, who sued ShopKo after suffering several skull fractures and a brain injury when he was thrown to the ground by a ShopKo loss-prevention officer outside a store in northwest Omaha in November 2008, the Omaha World-Herald reported (http://bit.ly/1L4RwvA ).
    Moore was confronted by two security workers after they said he pilfered two pairs of personal grooming scissors from the store. One of the workers, who outweighed Moore by 100 pounds, said he threw Moore to the ground when Moore resisted going back into the store. The worker said he feared Moore would use a pair of the scissors to stab him.

    The man no longer works for ShopKo. The newspaper reported that an attorney for Shopko couldn't be reached for comment. It's unclear whether the retailer will appeal.

    At the trial, Shopko defended the actions of its employees, who were not sued by Moore.

    Moore, who has said he has no memory of the day he was injured, pleaded no contest in 2009 to shoplifting and was fined $50.

      thats why they tell store clerks not to go after someone who stole something cause of this reason. It could of been more i knw its crazy cause they are committing a crime but also its to protect both parties. What if the idiot criminal has a gun and starts shooting up the place.

          yeh, they always tell store employees to just call police. the police can throw him to the ground, stomp his head, hell, shoot him, it don't matter for them. It will be justified in court for police.
          I'm still baffled by 2 security people at a thrift store. How big are this chains stores. When I think thrift, I think Dollar tree or Dollar General, places like that. Never seen security in places like that.

            I think I'll go to the Dollar Store, and steal a Snickers in plain view. Maybe one of those minimum wage, ham and egger cashiers will follow me out there, and knock me down.

              I worked at a Dilliards part time in the 90s, and they used uniformed off duty police as security. Apparently in the men's Dept by the main parking lot entrance, alot of Hilfiger n Polo were swiped regularly.

                Shopko isn't a thrift store, t is a regional department store similar to a Target or K-Mart.

                I just wanted to see how many idiots would applaud the decision. The dumbing down of America marches madly on and on and on...

                The $750,000 award will be overturned on appeal.

                  I'm not saying I agree with it. But we have lived in a litigious happy nation for awhile now. If this was pre 70s, hell, maybe even 80s. Just Regular store employees could of beat his azz, took the items back, told him he banned from store and he would of just went home with his azz beat and head down.

                  I would hope they appeal but I think it said happened in 08. It has probably already had settle offers, then trial. Lawyer fees have racked up, so store will probably hope to put it behind and move on.

                    Yes I can recall those days as well. I remember getting my azz kicked by a teacher and it wasn't a big deal. Didn't even tellmy parents about it because they would have kicked my azz all over again for doing something to get my azz kicked in the first place.

                    Ah the good old days. America was a much saner society back then.

                              Well, we can look at it like this. If you were in a car accident, your fault or not and was debilitated from it and couldn't work the rest of your life, the lawyer will ask for pain and suffering and loss of income to determine the award.

                              The same could be said for the shoplifter, though his fault, he was debilitated by security.

                              Mostly these cases sue the insurance companies. The store might've had a million dollar liability policy.

                              I'm not a lawyer, but I stayed in a Holiday inn once.

                                    A friend of my fathers got sued back in the 90's for beating the shit out of a guy that broke into his house. he came home early and caught one of the guys, but the other one escaped.

                                      i met a guy once who was very familiar with these types of situations, he told me in a case of home invasion, armed robbery etc, it is better for the victim if the courts hear only one side of the story....

                                                  The guy stole some scissors, according to the arricle, and nowhere does it say he threatened anyone with them, nor does it imply anyones life was threatened.

                                                  The big security guard was simply scared, he acted out of fear, that does not justify his actions. Last time I checked, walking around with scissors isn't against the law. No one has the right to assault you, or the thief, simply because they're afraid of what he might do with them.

                                                  If you're scared, call the cops and let them deal with it. As Toler said, this was a small settlement.

                                                  If the guy pulledbout the scissors and tried to stab the security guard, then I change my opinion, but until I read that, I think this is clear cut.

                                                      Of course this will be reversed or at the least, the amount will be lowered to some token amount like $10K to pay for medical fees. If nothing else, it will be tied up in court for a few years.
