i paid my taxes on my online poker winnings, for 2 years. amazingly, nobody ever showed up at my house to arrest me for playing online poker! it's not a trap of any sort, but you are supposed to pay your taxes
besides, the wording of UIGEA did not make it technically illegal for us to play online poker and withdraw, only for banks to knowingly process deposits to online gambling sites. the only thing you're at risk of getting in trouble for is not paying your taxes on winnings, but most people here wouldn't have to worry about that since most were probably down $ overall

Blanko's right. As much as i've read about online 'fixes' i'm assuming the great majority of us are down overall. No assumptions being made about anyone in this thread. Also, whoever said the rule is also right. Its never been illegal for US to play online. Idk where this misconception came from, but its just not correct. Its illegal to book, its illegal to participate in books within the US, its not illegal for us to do any of the offshores available. Its just not.

I would imagine that you have to request it so that after a certain period of time, DOJ gets to keep it through asset forfeiture. Standard operating procedure for the Federal Government. Blanko was spot on, the player has never been at risk for online poker as far as the Federal Government is concerned. If your state has specifically passed a law making online gambling/poker illegal, that is a different story. Claim your money, claim your winnings to the IRS on your tax return and you should have no problems.
