    Criminal Sentencing and Punishment
New York (CNN) -- A man who spent nearly 22 years in prison for a crime he did not commit was awarded $18.5 million by a federal jury.
Alan Newton, 49, was cleared by DNA evidence and released in 2006 from prison, where he was serving time for the rape and assault of a woman at a Bronx convenience store in 1984.
Newton started petitioning New York courts in 1994 to test the evidence for his DNA, but it took about 11 years and four formal filings and requests before authorities were able to find the rape kit, Newton's attorney, John Schutty, told CNN Thursday.
Newton, who received a 40-year-sentence in 1985, told CNN affiliate NY1 that he feels vindicated by Tuesday's decision.
"This says from a jury of my peers that we felt the system was wrong and we want to compensate you and we're also sending a message to the city," Newton said Wednesday.
"If you have DNA, you have the magic ability to prove right and wrong," Schutty said.
New York City's Law Department said it was "disappointed" in the Manhattan verdict and plans an appeal.
The Innocent Project took on Newton's case. Its website says Newton had an alibi and the actual perpetrator has not been apprehended.
The jury ruled that the city had violated his constitutional rights, and found two police officers liable for intentional infliction of emotional distress for failing to produce Newton's evidence when requested, the New York Times reported.
Newton, who said he intends to enroll in law school, said some relaxation is ahead first.
"I'm going somewhere hot and just taking time relaxing and letting it sink in for a little while," Newton told NY1.

I would not do it. Not for the time I would have to give up, but because you would come out of there with AIDS and/or Hep.

There is actually a movie coming out about this exact type of situation. It's based on a true story. Dude got out after like 20 hard years in the pokie, then he gets out after they find out thru DNA evidence that he was not guilty, and he dies 6 months later from HEP C.

I think Hillary Swank is playing his sister in the movie. I sure would like to give her my sausage for one night.

Oh hell no. I might of done 2yr for $20M cash when I was younger but now of his $18M his damn lawyer will get at least 1/3 and I wouldn't do 22 years for any amount of cash. My life & freedom is PRICELESS.

Key word in all that was "appeal" I'm sure the state will tie it up for years to come, then low ball him in the end. Getting a judgement and collecting a judgement are two different things. Even from states.

The most disturbing thing in this story to me is "New York City's Law Department said it was "disappointed" in the Manhattan verdict and plans an appeal." They lost dead to rights and they still want to appeal? Man up and admit you're disgusting pieces of filth and go on living like the snakes you are. You robbed this man of 22 years of his life. You should be the ones put in jail. Let him live his life now.

That works out to about $2,300 a day that he's getting paid for all the time he spent in jail. Not that I would want to do the time, but I would imagine that you get institutionalized and adapt to prison life. At least he wasn't like 79 when he got out. True, he lost the best years of his life, but at least he can enjoy the remaining ~40-50 years. The sad part is the prosecutors/DA that have immunity for doing this to the man. Nobody will feel the hurt from it. That's what taxes pay for. The juries that convicted him, the prosecutor that got the "win"; they're not being punished.
