    I wonder what the WTO Members will actually settle for anyways... I personally think it's stupid that they just don't reinstate online gambling in the first place in order to avoid adding more debt to the U.S.

    Antigua Wants $3.4 Billion; U.S. Offers $500,000

    Talks between the United States and World Trade Organization members who are demanding compensation because of the U.S.’s stance prohibiting its citizens from patronizing offshore online casinos continue.

    The U.S. met its Sept. 22 deadline with the WTO to make an offer to the countries that claimed America’s anti-gambling stance has hurt businesses located within them — but what the U.S. is offering and what the other countries feel is fair are way off from each other.

    A deadline extension has been granted by the WTO so that the parties can continue to talk about the case. The new deadline for when the sanctions should be decided upon is Oct. 22. Ultimately, it’s up to a WTO panel to decide upon the proper penalties, but this negotiation period is an early step.

    Antigua and Barbuda — the tiny island nation who, by going after the U.S. through the WTO in 2003, opened the door for countries to demand compensation — says that $3.4 billion is lost annually because the online casinos located there can’t do business with U.S. customers. Saturday, in a WTO filing, the U.S. said $500,000 was more accurate.

    It’s not known if the $500,000 would be paid in cash, through services, through copyrights, or by other means. Lawyers for Antigua and Barbuda have said that the WTO ruling potentially could allow it to make up for the lost business by ignoring intellectual rights laws. This means that Antigua and Barbuda would be allowed to legally produce copyrighted material that is made by American companies, something that organizations such as the Motion Picture Association of America have protested.

    The U.S. still won’t admit that its anti-online gambling stance violates WTO agreements. WTO panels have ruled that the U.S. violates agreements because it permits certain companies to host online gambling sites there — particularly horse racing sites — yet works to prohibit offshore countries from accessing the world’s largest consumer base of gamblers. The WTO contests that his clearly violates the GATS (General Agreement in Trades in Services) agreement the U.S. signed in the mid-90s.

    The U.S.’s main argument was that it didn’t know that online gambling could be considered a commodity when it signed the GATS agreement in 1995. Instead of complying with the WTO panel’s ruling and allowing its citizens to access offshore gambling sites, the U.S. Trade Office decided instead to amend the agreement.

    But WTO rules say that if a country post-edits agreements like this, countries that are affected by the editing change can seek compensation from the country. This is what Antigua and Barbuda and a handful of other countries are doing. Potentially, the U.S. and U.S. companies may lose billions of dollars because of this situation

    U.S. at least is saying they will settle but I think it is way way too low of an amount for a settlement, don't be surprised if they somehow will not enforce the new law in with a dollar amount of settlement for the trouble. It will be at least until Bush is out of office before this is done though I believe.

      I always get a kick out of people or countries in this case when they proclaim their innocense but are willing to make a monetary settlement.You get your sleezy slick Willy's and Michael Jackson's who do that stuff and their kool aid drinking cultists still proclaim their innocense.

      It would be a cold day in Las Vegas in July before I would pay anyone in an out of court settlement if I were innocent.You pay,you did the mollesting!

        Arent we hoping that the US doesnt pay and instead just repeals the IUGEA? After reading about how Franks bill is really anti-sports gambling I don't know what is best anymore

          A while back I pu the O/U at $1 billion. The US offering a half a mil is insulting. I still think a deal gets done but no where near either sides offer. Maybe a half a billion closes the deal. We will see.

              This is some funny sh*t. If I were President of Antigua I would attack America, send over a boat and have the entire 100-man strong army storm the US coast with stun guns. Then I would have the Antiguan propaganda machine make a video about how well the war is going and put that sh*t on YouTube.

              There's no way it will be ok to bet on the NBA and MLB in the US for years to come no matter what happens with poker, there's too much pressure against it and not enough pushing for it.

By the way John all the Asians have now settled in Clark, the Philippines. When shall we start seeing some reviews on them?

                    I'd suggest that the U.S. agree to settle this by offering to pay every documented online bettor a flat sum of one million dollars, tax-free, and in return extract from him/her a promise that he/she will never again bet online, or over the telephone to a book or gaming site outside the U.S.

                    Violators of the agreement, regardless of age, will upon conviction be obliged to serve in a combat role for a period of not less than one year, in whatever bizarre war our masters tell us if to (a)save democracy, (b) stop terrorism,

                    (c) make the world safe for Microsoft, (d) assure our unending supply of petrol, (e) lift the veil and the skirts of oppressed Muslim women, (f) stimulate the world economy, or (g) any other reason that the mass media tells us is for the greatest good of the greatest number.

                      The US has lied and stalled throughout the entire process and now you take their figures at their word? Remember the US has been claiming victory since 2005 until they capitulated and waived their last compliance appeal.

                      Antigua can and will back up their economic methodology. At the end of the day it doesn't matter what Antigua says the damage is or the US claims the damage is. It matters what the panel rules. This is the last one and there are NO appeals.

                      I can tell you Antigua is looking into some very interesting IP opportunities.

                        JC what happens if the US and Antigua come to an agreement on a settlement figure. Will WSEX and matchbook then pull out from the US? Would that be part of the deal? Of course I hope they will never leave.

                        Where do you see sports gambling heading in the US in the near future? Is it looking bad for the players?

                          Betting on sports is the world's oldest hobby. It will always exists, it's just a matter of how convenient it is.
