    $8.5 million win at casino; casino won't pay

    An Oklahoma woman gambling at the Newcastle Casino Friday morning claims she hit the jackpot for nearly $8.5 million, but she said the casino won’t pay her.

    She said she sat down at a Liberty 7s slot machine, betting $1.25 when she hit the jackpot.
    “As soon as the machine said she won the prize, the machine shut off. It went black. She didn’t know how much she had won at that point,” said Linda Sanchez, Maribel's daughter.

    hat’s when they say things took a very big turn.“It says clearly the amount that she won, but now they’re saying it was a malfunction and not give her the amount,” Linda Sanchez said.
    Maribel Sanchez took a picture of the machine after she won and shared it with FOX 25. The picture shows she won $8,469,498.95.
    “They told her we’re not going to pay you. It was an error,” said Bill Zuhdi, a lawyer representing Maribel Sanchez.
    “It’s crazy how they want to rely on ‘it’s a malfunction’ when somebody can easily go up there and lose all their money and ‘it’s a malfunction, give me my money back.’ It doesn’t work that way. So, why would it work that way for them? It’s pointless,” Linda Sanchez said.
    “We’re going to go through the process that is provided by the casino at this time. We’re going to look at all her legal options and aggressively pursue her rights. She should be paid what she won,” Zuhdi said.

    I watched the video and this lady doesn’t have a chance in hell. It looks like the machine restarted or reset and was going through diagnostics and in very tiny letters it says WON 8,469,498.95. If you won 8M the machine would be screaming at you and the rest of the casino, “look at me, look at me”. She’ll get a free steak dinner if she’s lucky. It’s a video slot too so it’s not like the reels stopped on Jackpot-Jackpot-Jackpot. Just a little box on the screen mixed in with a bunch of numbers saying WON 8,469,498.95 . Better luck next time lady.

    Doesn't this happen all the time with these slot machines malfunctioning, but it clearly shows on the machine that the maximum payout for the machine is usually a far smaller number than this malfunction shows them to have won?

    If that's the case, really don't see how they can ever have a case. Have heard about this happening at least two or three times before...

    Spot on. All machines in every casino state somewhere on it that “malfunctions void all pays and plays”. On a reasonable malfunction dispute most casinos will reimburse guest. This is not a reasonable dispute.

    Unless the machine is some statewide progressive or a $500 and up a pull, there is no way it would have a top jp of anything even close to 1 mil, let alone 8 mil. If it is a statewide, the slot manufacturer pays out the jp and when they open machine’s board to verify if it is legit, it will show a malfunction somewhere in the program, voiding what was displayed on monitor.

    She gets her 15 minutes of fame, people who don’t really understand how it works will get upset and support her and in the end she will be back in some casino playing some other penny machine without the 8 mil telling the story to anyone who will listen

    I think there was a case recently where some person (maybe some couple) had a bunch of $ accidentally put in their account by the bank. They went on a spending spree, but naturally when the mistake was caught they were told to pay it back. And when they couldn't, obviously they faced criminal charges.

    In short, when there is a bank error in your favor, that doesn't entitle you to keep the $, it's not legally yours. Failing to see how this is different - some type of software error "gave" you (or made you think you won, whatever you want to call it) a bunch of $ that you didn't actually win/weren't entitled to. Why do people think in this case anymore than the bank case that you would have any basis to try to keep/get the $?

    Perhaps in part has to do with the fact that casinos are seen as greedy money making machines so people take more pleasure out of them "losing" whereas a bank is more something that provides services rather than just trying to suck your $ away from you. But whatever the intention of the institution, still don't see how a clear error that makes you think you won something which you didn't gives you any basis to get/keep such $ compared to a bank accidentally putting a bunch of $ in your account due to some type of human/software error.
