    Question regarding bike accident and suing driver
    My dad got hit by a car yesterday while riding his bike. He was riding on a busy boulevard, close to the curb with an onramp to a high way coming up. As he camp up to the on ramp for the highway there was a woman driving parrallel and or slightly in front of my dad and saw my dad on his bike and was letting him pass her so she can go on the high way. the car in back of the woman got impatient with her bc she had stopped in front of him and decided to pass her to get On the highway. He did not see my dad and hit him. He totaled my dads 7,000$ bike and broke my dads wrist along with some cuts and bruises. An accident report was done, and the woman driver stoped to be a witness. My dad works for himself doing home remodeling. He's going to sue, so I was wondering how much you think he'll Probly get???

            Sorry about that jpag. It sounds like he escaped serious injury except for the wrist.

            I don't think he will get too much. If your dad wins he will probably get the depreciated value of the bike, medical bills, money for lost income and possibly a few bucks on top of it. He may see 10-15k or so depending on how long it takes to heal. I wouldn't be expecting to purchase a vacation house with the money or anything. Most of the $$ will be to cover his costs incurred. The key will be how much work he misses because of it. Since he needs to use his wrist for his job he will probably get reimbursed for any work he can't do because of it so the amount of $$ will be largely dependent on how long it takes his wrist to heal. They will probably require a year or two of tax returns to determine the average income per month and go from there.

            They are not going to say he lost $15,000 in work, bike and medical bills then throw $100,000 on top of that. They may tack on $2,000 for pain and suffering, but I would think that would be about it, if that.

                  Yeah thanks balls2walls, hes alright he's home now, sitting in his den watching his 65" tv, he's just pissed he can't go bike riding for a few weeks. He's crazy for it, goes like 300 miles a week. Thanks for the answer back bc that's what we were talking abut after I got him from the ER

                      It sounds like he will be back in action in a few weeks.

                      If the sole purpose of suing is to win a lot of $$ on top of the medical and other bills then I would try not to go to court. IF he wins any extra money it probably will not offset his lawyer fees. If he was paralyzed for life or something then you would be talking about some $$. From what you said I don't think he is going to get much of anything on top of his expenses.

                      I would probably contact the guy's insurance company and try to get all of his expenses covered by them and forget going to court. You may need a lawyer or your dad's insurance company to get them to pay the correct amount, but I would think they would pay the legitimate bills without much of a fuss.

                      Of course, you probably want to contact a lawyer and ask him what he thinks since I am obviously not one. The lawyer is going to want to go to court and get as much in fees from you as he can though.

                        Find a good lawyer bud. With the right lawyer you'll get plenty of money-by suing her insurance company your dad will be able to rack up. Every insurance policy has a maximum amount they will pay for injuries and such, you need to make sure you get the max amount her policy/coverage allows. Trust me on this, not only do I work in the insurance business, I've had a similar experience happen to me.
