            This is the New Colorado Law That Protects Citizens’ Right to Record Police

            Back in April, we reported that there was a new bill in Colorado that aimed to protect citizens’ rights to record police and to punish officers who interfere with those rights. Well, good news for photographers: the bill has been signed into law.

            The title of HB 15-1290 was “Stop Police Interference Cop Incident Recordings,” and the summary said that the proposal was: “Concerning prohibiting a peace officer from interfering with a person lawfully recording a peace officer-involved incident.”

            Colorado Governor Hickenlooper’s office is now announcing that HB 15-1290 is one of the bills that were signed into law on May 20th, 2015.

            The law affirms that citizens have a right to record “any incident” involving an officer and the right to maintain “custody and control” of both the recording (e.g. photos) and the device that was used (e.g. the camera). The law also says that citizens have the right to take civil action against police officers who interfere with their recording.

            Citizens are entitled to the replacement of damaged devices, $500 for damaged or destroyed recordings, legal fees, and punitive damages of up to $15,000.

                        Fire And Police Videos obtained lapel footage from the Rio Rancho Police Department in New Mexico. It shows the arrest of Albuquerque Police Officer Jeffrey Wharton prior to his shift beginning. He was taken into custody by detectives of the Rio Rancho Police Department. The on duty arrest was due to a warrant for his arrest from the Rio Rancho PD.

                        According to the criminal complaint, Wharton beat his girlfriend so badly, she had several gashes on her head and face. Police say her injuries were so severe, she had to be taken to the hospital where she was diagnosed with a brain bleed. Some of the domestic incident was captured on the couples "RING" doorbell system.

                        Rio Rancho Police officers removed his duty belt and searched him. After the search they are seen on lapel video cutting off his uniform. Wharton was lead out of the substation to a cruiser. He was booked into Sandoval County Detention Center on charges of Kidnapping (First Degree) (NO Intent to Commit Sex Offense), Aggravated Battery (great bodily harm) (household member), Aggravated Battery Against a Household Member (Strangulation or Suffocation), Aggravated Battery (great bodily harm) (household member), Tampering with Evidence (Highest Crime a Capital, First or Second Degree and Negligent Use of a Deadly Weapon (Unsafe Handling).

                        Wharton resigned from APD shortly after this arrest. APD says Wharton had been with the department since November 2010. He was a senior officer with the department. His trial is pending.

                        Last year we uploaded a video of Albuquerque Police Officer Jeffrey Wharton being cuffed and having his uniform cut off of him. He was being arrested for felony domestic violence against his partner. The Prosecutors and his lawyers struck a plea deal. He agreed to 3 years of supervised probation. Wharton has since been fired by Albuquerque Police Department and his state law enforcement certification is being reviewed.

                                Off-Duty Road Raging Cop Chases Down Teen, Shoots Him — NOT Arrested

                                East Greenwich, RI — If the average citizen chased down a motorist, blocked them into a parking lot and opened fire on them in an act of road rage, rest assured that person would be immediately arrested. However, because of blue privilege, an off-duty Pawtucket police officer — in a fit of road rage — was seen on video chasing down an 18-year-old, shooting him as he tried to get away, and was not arrested.

                                Pawtucket Police Chief Richard Ramsay explained that the obvious act of road rage you’ll see in the video below started on Interstate 95 and continued off of exit 6. On June 23, police responded to a report of shots fired in a parking lot and when officers arrived, they learned the Pawtucket police officer had shot the 18-year-old West Greenwich resident in the arm.

                                Ramsay explained to local media that the teen was taken to Rhode Island Hospital and is expected to survive. Though the chief mentioned that the officer is cooperating in the investigation, there has been no mention of charges or an explanation of why the officer was not charged.

                                As the video below shows, the off duty cop is in the white pickup truck and appears to be chasing the black car. When the black car pulls off to attempt to let his crazed stalker drive by, the crazed stalker tries to block him in before jumping from his truck.

                                The off duty cop then grabs something from his hip — presumably a gun — and chases down the black car as it attempts to get away.

                                Chief Ramsay noted in a statement that the cop used his department issued weapon when he shot the teen. He also noted that the officer involved is on administrative leave.

                                In a statement, Acting Public Safety Director Chief Tina Goncalves said:

                                "On Wednesday June 23rd at approximately 8pm the Pawtucket Police Department was notified by an off-duty officer that he was involved in a shooting in West Greenwich. There is a protocol in place with all officer-involved shootings that the investigation is handled by the Office of the Attorney General, the State Police, and the local jurisdiction where the incident occurred. The Pawtucket Police Department is waiting for further information on the investigation. Pending that, the officer has been placed on administrative leave. Any and all questions should be deferred to the Attorney General’s Office."

                                According to Rhode Island’s Stand Your Ground law, anywhere outside your home, before deadly force is legal, there is a duty to retreat — meaning, if you can get away without using deadly force, you must do so.

                                It is clear in the video below that this officer not only failed to retreat, but actually provoked a situation in which he was the aggressor and blocked a person in who was retreating. If the 18-year-old would have shot the officer, the 18-year-old would have been more justified in the shooting than the cop who shot him.

                                Anyone who watches the video can clearly see that the use of deadly force was not made in self-defense, making it an act of assault. Had anyone but a police officer used such deadly force against another motorist, rest assured they would be in jail right now.

                                                              Cop Kills Unarmed 17yo Boy As He Held a Quart of Oil Working on His Truck

                                                              Lonoke, AR — Family and friends of 17-year-old Hunter Brittain have been protesting nearly a week and demanding answers from police after an officer shot and killed him as he worked on his truck. So far, the police have remained tight-lipped and have refused to release any details. Brittain’s friend, however, who was with him the morning he was killed, is speaking up — and his words describe what appears to be a blatant act of murder.

                                                              On the morning he was killed, Brittain and his friend Jordan King, 16, were working on his truck’s transmission so Brittain could drive to work later that morning. Brittain’s boss, Scott Hundley, who owns Hundley Construction, confirmed to KATV that he spoke with Brittain the night before to line up a ride to work if Brittain couldn’t get his truck fixed.

                                                              “I was checking with him on his truck,” Hundley said. “[He was] sending me pictures of his truck at the shop. He says he’s been working on this truck but he’s trying to make it.”

                                                              But thanks to Lonoke County sheriff’s Sgt. Michael Davis, Brittain would not make it to work the next morning. And, according to King, it’s because Davis murdered him.

                                                              King spoke to KATV off camera and detailed how the situation unfolded. He told reporters that he and Brittain had worked through the night to fix Brittain’s truck and after they finally got it running they took it on a test drive around 3:00 a.m.

                                                              According to King, while on their test drive, Davis pulled them over about a mile from the shop where Brittain was working on his truck. The shop, Mahoney’s Body Shop, according to King is owned by a friend of their family and they had permission to be there to fix Brittain’s truck.

                                                              King said Davis pulled them over on Arkansas Highway 89 and within just a few minutes, Brittain would be killed.

                                                              As KATV reports, King said Brittain’s truck wouldn’t go into park, so Brittain got out to grab a blue oil jug to put behind his truck’s tires and stop it from hitting Davis’ car. According to King, Davis then fired without telling Brittain to stop or get on the ground.

                                                              “They didn’t say one word that I know of. I didn’t hear it and it happened so fast,” King said.

                                                              King said after other deputies showed up, he was then handcuffed and forced into the back of a police cruiser for hours as he watched his friend bleed out on the pavement in front of him.

                                                              “[He] told me get out with my hands up and pull my shirt up and stuff, and then took me to the ground, put me in handcuffs and was dragging me around and stuff,” King said. “And then I sat in the back of the cop car for about three hours.”

                                                              King said he told deputies that he had no idea why Davis killed Brittain as he had no weapon and wasn’t doing anything wrong.

                                                              Adding to the suspect nature of the killing is the fact that Davis was wearing a body camera, but Lonoke County Sheriff’s department won’t confirm whether or not it was even recording.

                                                              “Sadly, on social media, some people are demanding I take action without waiting for evidence. That’s irresponsible, and I won’t do it,” Lonoke County Sheriff John Staley told protesters outside his department last week. “There’s a lot of misinformation on social media. Don’t believe it. Let’s all wait until the facts are confirmed.”

                                                              But family members aren’t buying it.

                                                              “I am not a vengeful person, but this police officer doesn’t need to be a police officer,” Rebecca Payne, Brittain’s grandmother, said. “There needs to be more training for the ones that they have, and I want him to not ever be able to carry a weapon again. And if this is means he’s going to prison, then that’s what it’s going to have to take.”

                                                                      Innocent Man Arrested, Held on $50K Bail for Holding Up a Sign in Public

                                                                      Kitsap County, WA — Robin Hordon, 73, is an American citizen who is outspoken about his views on anti-militarism, feminism and environmental stewardship. He is known around town for holding signs to advocate these positions. However, in 2019, several constitutionally illiterate cops kidnapped him on the Fourth of July for holding his signs — a constitutionally-protected act — in a public park.

                                                                      For the last two years, Hordon has been attempting to hold the cops accountable for what they did to him that day, and this month, he was successful.

                                                                      On that day in 2019, Hordon was holding signs he calls “temporary free speech presentations” when deputies arrived to force him to leave. Knowing he was well within his constitutional rights to hold signs in a public park, Hordon refused to leave when police arrived.

                                                                      To be clear, the signs did not contain profanity or anything remotely offensive. One side of the 6-foot sign read “Protect Democracy Vote,” and the other side read “Save Earth.”

                                                                      Because he stood up for his First Amendment rights, deputies arrested him and threw him in a cage. His bail was set at $50,000 — in spite of the fact that he had no criminal record and the charges were for non-violent offenses.

                                                                      Unable to pay the massive bail amount, Hordon was forced to spend the next night in jail before a judge released him on no bail. Police then “permanently banned” Hordon from the park.

                                                                      While awaiting trial, Hordon returned to the park to take photographs in preparation for his defense and when deputies spotted him, they arrested him once more. Hordon was subsequently charged with three counts of second-degree criminal trespass.

                                                                      Likely realizing they had no legal case against Hordon, prosecutors eventually dropped all the charges and rescinded the “permanent ban” from the park.

                                                                      This month, Kitsap County and the Port of Kingston paid Hordon a total of $400,000 — $250,000 from the county and $150,000 from the port — for the laundry list of constitutional rights violations over being twice jailed, held on “excessive” bail and “forever” banished from the park at the port.

                                                                      As part of the lawsuit, the Kitsap County Sheriff’s department will be forced to undergo “free speech training” and make policy changes to make sure they never infringe on someone’s rights like this again. The county also agreed to changing the bail policy after setting such a disproportionately high bail for Hordon.

                                                                      Hordon told the Kitsap Sun that he didn’t think he would get any money from the lawsuit and only sued the county to get policies changed.

                                                                      “I was standing up for making the Constitution work,” he said. “I refuse to give up my First Amendment rights. Then what happened after that is basically they dug their own financial hole,” adding, “I’m not thinking ‘cha-ching.’”

                                                                      Though the county did not admit wrongdoing, Hordon’s attorney says the policy changes are pretty much exactly that.

                                                                      “This is meaningful for him,” Hordon’s attorney, Joe Schaeffer said. “It goes beyond him and betters the system for everyone, quite frankly, including the police. For me personally, it is a rare case where we see significant, substantive policy change.”
