Tracer been to prison for shooting someone. Attempted murder. I plead out, to assault 1st degree. Did 7 years. You don't go to Federal prison for that asshole. Federal prison and State prison are 2 different things

Sorry - assault laws super tough in NY compared to TX. Class D felony - would be a 4th degree here (or state jail since 4th degree doesn't exist in TX) - would STILL be probation.

2 Years imprisonment will be probated for sure if it's your first offense. I know for a FACT that NY has no room to put first time, no rap sheet, street brawlers in jail for their first offense. Get a lawyer, might cost you 3-5K. Or get a public defender. If the evidence is thick against you, IE police reports, witness statements, pictures of injuries, hospital reports - just go with a public defender. Chances are, you'll get the same deal - not like you can pay to make the evidence go away.

Because a lawyer can do nothing for you at that point. You can use your own common sense. You will need a good lawyer down the line, but not in the beginning. All he will say is to don't talk to the cops. Turn yourself in and ask for a lawyer. They won't be able to talk to you anymore. They don't actually call a lawyer, because they know the lawyer will advise his client to shut-up.

He went to regular state prison. Still gladiator school. A lot of state prisons are tougher than federal prisons anyway.

But was his first offense, and seemed like a heavy sentence to me. Wanted to share my experience, clearly I'm far from an expert but I know assaults/fighting is taken much more seriously now than it was 10 15 years ago

Adam, there is also a huge amount of circumstances to look at - did your guy have a weapon? Aggravation can be established in multiple ways. Using a bat, reckless amount of force, relative size comparison of the two "fighters" - for the most part, it's hard to beleive someone goes to jail for a first time assault, but I guess it's possible.

Only if your cop's a dick. I've gotten bicycle delivery service to my hotel door before in NY, seen plenty of friends get "caught" smoking a J or rillo - no problems.

Problem is in Texas 99/100 cops will take you down, in NY, the number isn't even close to that high.

I do applaud them still for making sure "thug" dicklicks stay off the street, and in jail where they can't waste our space.
