Different States have different sentencing structures. You goto prison here when a Judge sentences you to prison regardless of the sentence. You cannot get felony assault anywhere I have been for punching a person. If he kicked him with steel-toe shoes, YES! Punching, NO! ... UNLESS your friend is a habitual offender.

In TX you would likely only spend a night in jail for a one punch knockout. Then released and not charged. That's in the unlikely case that someone actually called the cops over it. Fighting is not that big a deal here. At least where I'm from. You would have to ruthlessly beat someone to get into any real trouble. Even then, if they threw the first punch, you would get maybe 6 months probation.
