Super Bowl XLVI Coin Toss Pizza Giveaway
Official Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: Super Bowl XLVI Coin Toss Pizza Giveaway (the "Promotion") is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least thirteen (13) years old. Employees of Papa John's International, Inc., the National Football League ("NFL"), its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC, and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents representatives (collectively, "NFL Entities"), PepsiCo, Inc., third-party partners or entities involved in the creating, administration or support to this Sweepstakes, including ePrize, LLC and Fleishman-Hillard, and their respective affiliates, assigns or representatives, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. 3. Timing: The Voting Phase begins on January 22, 2012 at 12:00 a.m. Eastern Time ("ET") and ends on February 1, 2012 at 11:59 p.m. ET. To be eligible to receive a free large one-topping pizza and a 2-Liter Pepsi product (the "prize"), participants must register for Papa Rewards as of 6:00 p.m. ET on February 5, 2012. If the prizes are awarded, all eligible Papa Rewards members must complete the prize claim form by 11:59 p.m. ET on February 19, 2012. Administrator's computer is the official time-keeping device for the Promotion.
4. How to Participate: During the Voting Phase, visit www.papajohns.com and follow the links and instructions to vote for what you believe will be the outcome of the Super Bowl XLVI coin toss. If the majority of votes correctly predicts the outcome of the Super Bowl XLVI coin toss, all Papa Rewards members as of 6:00 p.m. ET on February 5, 2012 will be eligible to receive the prize. In the event of a tie in the number of votes regarding the outcome of the Super Bowl XLVI coin toss, John Schnatter, founder of Papa John’s, will flip a coin where each coin face will be assigned to an outcome and the side that lands up will be deemed the outcome the majority selected.
5. How to Claim the Prize: If the majority of votes correctly predicts the outcome of the Super Bowl XLVI coin toss, all Papa Rewards members as of 6:00 p.m. ET on February 5, 2012 will receive an email with instructions on how to claim the prize: free large one-topping pizza and 2-Liter Pepsi product. To claim the prize, Papa Rewards members click on the link in the email and complete the prize claim form at or before 11:59 p.m. ET on February 19, 2012. After Administrator has verified Papa Rewards membership, you will be taken to the prize claim confirmation page where you will receive a unique, one-time use prize promotion code that can be redeemed at papajohns.com. Papa Rewards members who fail to complete the prize claim form by 11:59 p.m. ET on February 19, 2012 will not be eligible to receive the prize promotion code.
6. Prize Details: Each Papa Rewards member who claims the prize will receive a prize promotion code that can be used to purchase a free large one (1) topping pizza and a 2-Liter Pepsi product. Prize code must be redeemed for the prize on or before March 4, 2012, the expiration date of the prize promotion code. Approximate Retail Value: $12.79. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for another item of equal or greater value if the prize should become unavailable for any reason. Prize recipients are responsible for all taxes and fees, such as delivery and minimum order requirements associated with prize receipt and/or use. Offer is valid at participating restaurants only. odds of prizes being awarded are approximately 1:2. 7. Release: By receipt of the prize, each Papa Rewards member agrees to release and hold harmless Sponsor, the NFL Entities, PepsiCo, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, and advertising/promotion agencies, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Partiesâ€) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of the prize.
8. Publicity: Except where prohibited, participation in the Promotion constitutes each Papa Rewards members' consent to Sponsor's and its agents' use of his/her name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the voting process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the voting process or administration of the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of votes; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Promotion or receipt or use or misuse of the prize.
11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
