    Dell Computers Rapped by NY Supreme Court
    Came down in late June. Not a surprise for many buyers of Dells.

    Abstract:

    Justice Joseph C. Teresi said in his decision, “Dell has engaged in repeated misleading, deceptive and unlawful business conduct, including false and deceptive advertising of financing promotions and the terms of warranties, fraudulent, misleading and deceptive practices in credit financing and failure to provide warranty service and rebates.”

    According to the decision, Dell deprived consumers of the technical support to which they were entitled under their warranty or service contract by:

    • Repeatedly failing to provide timely onsite repair to consumers who purchased service contracts promising “onsite” and expedited service;

    • Pressuring consumers, including those who purchased service contracts promising “onsite” repair, to remove the external cover of their computer and remove, reinstall, and manipulate hardware components;

    • Discouraging consumers from seeking technical support; those who called Dell’s toll free number were subjected to long wait times, repeated transfers, and frequent disconnections; and

    • Failing to provide rebates that were promised to consumers.

    Justice Teresi concluded that Dell lured consumers to purchase its products with advertisements that offered attractive “no interest” and/or “no payment” financing promotions. In practice, however, the vast majority of consumers, even those with very good credit scores, were denied these deals. In a classic “bait and switch” scheme, DFS instead offered consumers financing at high interest rates, which often exceeded 20%. Dell and DFS frequently failed to clearly inform these consumers that they had not qualified for the promotional terms, leaving many to unwittingly finance their purchase at high interest rates.

    The decision also held that DFS incorrectly billed consumers on cancelled orders, returned merchandise, or accounts they did not authorize Dell to open, and then continually harassed these consumers with illegal billing and collection activity. Although many consumers repeatedly contacted Dell and/or DFS to advise them of the errors, DFS did not suspend its collection activity and Dell failed to expeditiously credit consumers’ accounts, even after assuring consumers it would do so. As a result, many consumers have been subjected to harassing collection calls for months on end and have had their credit ratings harmed.

    Justice Teresi ordered discovery in aid of restitution by Dell to be completed in four months and an injunction to prevent any recurrence of the misleading, deceptive and unlawful conduct by Dell.

    There are a fair number of anti-Dell sites. So many that one of the first, dellhell.com, evidently was bought out by Dell.

    (But DellHell.net isn't owned by Dell.)

    Every major company has some variety of "-------- Sucks!" online, but Dell, as noted, has a ton. Because the rep they made 8 years ago is now totally undeserved. Sort of like the Cascade Sportsbook . . . . things change, ya gotta keep up.

    One thing i did see on one of the antiDell forums is a guy who edits a 100000 readers online magazine did write to Dell and got satsfaction.

    He uses his laptop 8-12 hours a day. He bought a Dell Insprion. And experienced many problems. None of which were solved by their Indian cs dept, who just read from a printed script.

    So he wrote Michael Dell. And got two execs replying, telling him that they would repair or replace his product. And they did repplace it.

    They told him (altho they don't advertise it) that for heavy users of laptops, or if you are lugging it around a lot, spend a few extra $$ and get their Lattitude models, more for heavy or business use.

    The editor was happy with the resolution, but still determined not to buy Dell again. Nor will I, after a 2.5 year old Inspriron had the plug in at the motherboard go bad - unrepairable.

    Posted just for info, as I would if I came across a top-rated book that had demonstrable problems or many unresolved complaints. Forum habituees, for the most part, are hard on thier laptops.

      Dell does have an eye popping # of those websites. I think we can assume some of them were created when Dell seemed to be mopping the floor w/ competitors, but having read some of them yeah they do have a pretty passionate anti-fanbase.

        Dell is the number two computer rip-off company after Apple. The masses remain uneducated and irrational, falling for the scams. Do I feel sorry for them? As much as I wished to love the humanity I am just incapable of that...

          I don't really want to get into another PC vs Mac debate, but can we at least agree that Macs are for more efficient "out of the box" than any PC with respect to operating systems? Come on- Vista? Ridiculous. XP Pro is decent but again, XP and Windows in general just has so many more pitfalls that a user runs into. Unless you can fix things on a whim yourself, why spend the headaches with PC's? For someone who doesn't feel like reformatting every few months or opening his case to sniff around for issues, Mac is the way to go.

            i worked at a UPS service center one time , they contract and runs shipping or storage for companies. One account was for a big accounting firm called Earnst & Young, E&Y had somekind of contract with Dell to use their laptops for all of their accountants or reps, well UPS would track and ship the new laptops or the ones needing repair or whatever. basically in a section of the warehouse there were UPS employees that took care of all of E&Y's Dell products, any that had their lease up got returned to UPS first, any needing repair got returned to UPS , any new ones going out or repaired ones got shipped by UPS, UPS had their own tech department that fixed them for E&Y instead of them being sent to Dell to be repaired, they only went back to Dell after the lease was up. I remeber a E&Y person telling me it was cheaper and faster to let UPS run it for them instead of them trying to do it all and have to deal with sending laptops back and forth to Dell.

              I can't hate Dell after they honored a pricing mistake which allowed me to buy a $1000 XPS for $300.

                  No magazines, just used lots of PC's and Windows OS' from Millenium to Home to Vista or whatever all seem inferior to any kind of Mac I've used. Less BS/viruses/annoyances. I'm not saying you can't build a PC to run just as optimally or out perform a Mac in certain areas with the right components, but strictly out of the box Mac and their OS' are simply more reliable than the crap one can buy from these companies like Dell, Compaq etc. Not talking about "super 8 million quad machines", just regular machines in the 1.5-2.5 dime range.

                    I agree with you that Macs are good for the job their users need them to do.



                    The Macs are very reliable, easy to use, fun and unlikely to get infected with a viruses. You must not kid yourself that you are using a computer if you are running a Mac, though.

                    For those of you who is running Linux on a Mac. You are using a computer but you are a pervert. There is nothing wrong with being revolutionary while you are 18. When you grow up you will give that nonsense up.

                      And your machine of choice is ......................?

                      Most Apple users seem satisfied. (I've used them, mimimally, at friends' houses)

                      In the last week I've had three people in the pc repair biz or related (but none selling computers) tell me that for laptops, for the money, the higher-end HPs are best. (Which surprised me.) Most trouble-free, I think they mean. "Cause the great majority of pc users (like car buyers) will sacrifice great, eye-popping performance for solid reliability.

                      I mean, I coulda went with some crap like Gateway for hundreds less than I paid for the Dell laptop, and it likely woudl have lasted trouble-free for longer than the Dell did.

                      So, your recommendation - and why ........ ??

                        Likely, they were referring to the machines that came from the Compaq side of HP. I have never been impressed with a single HP computer. In contrary, Compaq high-end laptop have always been solid (like Presario line dating back to 90s) while their current budget offerings provide great value.

                        Again, it depends. There are many manufactures that provide either reasonably priced quality or value with a decent quality. Then, there are always some exceptions. Well, it is getting late...
