(Memphis 6/6/2011) Instead of a present, a Memphis, TN man brought a gun to a child's birthday party.

Joseph Hayes, 48, is charged with aggravated assault.Police say Hayes brought a gun to the party because his children didn't get any ice cream or cake

A police affidavit says Hayes became upset and began yelling at the victim.

Police say he went to his apartment and returned a short time later with a small black handgun tucked into the back of his pants.

Hayes approached the host, lifted up his shirt and said, "I ain't scared to go to jail, just take care of my kids."

Hayes' bond is set at $30,000.

There is a reason an arrest report has a minimum of 5 lines on it:

-Aggravated assault

-unlawful discharge of a firearm within city limits

-reckless endangerment

-disturbing the peace/ disorderly conduct

- menacing

- illegal/unregistered handgun **assuming it is in a particular case**

At least ONE charge will stick.....see how that works

If it was a gathering for the party, and he said to a person there anything related and then pulled the gun while engaged in an argument....then it's aggravated assault.

Bottom line the dude is in the wrong....deserves whatever they give him sentence wise.....it's bad enough to have to use a gun to settle any argument with an adult...but to inject it where kids are around??? no excuse for that.

A) I have the joy of being married to the daughter of a former prosecutor...who retired doing defense work....so I deferred to him on it...he was correctly charged. wait to see if he pleas down to a lesser charge to avoid sentencing from here out. (I'll bump this thread when I hear a verdict on his case)

B) Doesn't the fact that you got CONVICTED infer that you need some brushing up on the intricacies of the statutes?
