It shouldn't matter. If the big kid did something earlier the little prick can't claim self defense later on. There are some major problems with the court system if the parents of the little guy win anything.

Big guy was hit more then once before even doing anything. He slammed him and walked away. Once the threat from the kid was gone he left. If he stomped the kid after the fact then I could understand the lawsuit as far as the law goes.

You didn't see the bigger kid step in? That little guy doesn't walk around alone. The big kid could have very few friends so it makes it easier for him to be bullied. Plus if he doesn't do anything then he will be picked on more. There will be fewer trying to pick on this kid now.

I wish I had video of a punch I saw a long time ago. Huge guy had a little guy bugging him. Little guy was drunk and kept chasing the big guy. The big guy was walking away and ignoring him...little guy kept it up and the big guy pushed him away...next pushed him to the ground (twice I think)....little guy came back bugging him so the big guy turned around and punched the guy once and laid him out cold. We were on a balcony watching it all. Fuking hilarious. The little guy was out cold for a couple minutes. The big was probably 350-400+ pounds. Hard to say what the little guy weighed but probably under 200. He was 6-8 inches shorter as well. Big guy might of been 6'5" or taller. But he was HUGE. One of the funniest things I ever saw.

The video is from Australia. The bully ended up with a broken ankle from the slam. Serves the little prick right if you ask me. Sure the fatty over reacted with excessive force but it was due to being punched in the head. The poor kid just walks off after it all.

For provocation and/or self defence to be made out the response needs to be proportionate and reasonable - the law is quite strict about people going too far. It is a common element to both defences.

From what I could see, the fatty was in no danger of imminent harm and wasn't being hurt, so self defence may be a tough sell. My view is that the slam was excessive. Fatty had other options - this was particularly dangerous and designed to cause serious harm - the love taps to his face weren't.

Provocation would be another tough sell, but slightly easier. It would depend a lot on the history between the two...

Fatty needs to learn that you can't go too far and, at his size, he will kill someone one day if he does.

Its a lucky lesson for both of them, whatever happens - bully won't be picking on people anymore and fatty won't be going that far again in a hurry.

edit: legally, i reckon the school if going to have a few questions to answer.

Rod, bullying doesn't always have something to do with size. Some of the biggest jerks I've known, either throughout school or after, were the little guys. What they lack in size they make up for in emotional warfare. We have no clue what state of mind that bigger kid was in. Was he insecure about his weight? Did he have crappy grades? Did he come from a home without a lot of money?

There are a thousand things one can bully someone over and just because someone is bigger than someone else, that doesn't mean the larger child has the desire or even the confidence to fight back, either with words or with his fists. Especially not when a lot of twerpy brats all pile up on the 'weak' one.

I can't believe I'm going to say this but that little kid got what he deserved and if I was his mother and found out that he and his buddies had been tormenting another kid for 3 years and this was the end result, I'd most likely tell him that I hoped he learned his lesson. Beware the gentle giant.

And how could the bigger kid be charged with attempted murder? Not only is he a juvenile but attempted murder involves premeditation. This kid defended himself after being hit by the skinny twerp. It's called self defence.

If anyone were to be charged, it should be the little kid with aggravated assault for instigating this fight and being a dumb ass. But of course, they are children so nothing will happen.

Shari: murder does not involve premeditation. Murder involves doing an act that kills with an intention to kill or do serious harm. If fatty dropped bully on his head and the kid died, there would be serious charges.

Attempted murder requires an intention to commit murder. That wouldn't work.
