The two companies can challenge the attorney general’s order in court. According to Joseph M. Kelly, a professor of business law at the State University College at Buffalo, the state would have to prove that chance is a material factor in fantasy sports, which would make it gambling.

Fantasy would not work offshore would it? Fantasy players appear to buy in for small amounts and cash in for small amounts don't they? People want to play it - I say fine bu,t it seems to stress the DOJ and the banking system which might shine the spotlight back on sportsbetting and poker????

They sent cease-and-desist letters to those 2 companies, but the law impacts the entire industry.

I do not believe there are any avenues of appeal. This is not a court ruling. As you mention, they could file suit, but good luck getting that resolved within the next decade.

if they didn't blitz the country with ad's and have guys bet on the others DFS sites, they wouldn't be in this spot. They really handled this as poorly as you can.

you can do all the research in the world and think it's skill based, till the top RB choice of the weak tears his ACL early in the game. It's totally more luck then skill. It should be a question that if they make this legal, why wouldn't sports betting be illegal. You either have to make DFS illegal or make all sports gambling legal.

I believe this makes 7 states where it is illegal - including Nevada saying they need to go through the licensing process.

I think this will lead to that. Here's why:

More and more people are coming around to the notion that DFS is gambling, so it is being declared illegal. But the leagues love DFS - in fact, the leagues are heavily invested in DFS. They are also the biggest opponents of sports gambling. They may have to drop their opposition to legalized gambling in order to keep DFS's up and running.

This is exactly what happened to poker, it got huge quick and the world series of poker was always on tv, commercials for every poker site on every 10 minutes. Then it all went away when the feds got tired of it.

Nothing "geeky" about $1500 12-man leagues. A far cry from the $100,000 "guaranteed" pots with $1 buy in that end up having over 500,000 entries. There are pros and novices in fantasy, just like there are in gambling. I happen to enjoy both, and again, nothing wrong with that.
