Cudi if you watch the video and hear the ppl at the track that's all the evidence you need. Like i said dumb move by kid but when 4 other cars go right by him after he gets out and Tony shows up and is only one to NOT see him and then speed up and rev engine are you serious? What the hell was that kid thinking when he ran onto the track. The lighting looked horrible, and the kid was wearing black, of all colors. When you are in the middle of a competitive race, one of the last things you expect to see is a driver jumping in front of your vehicle.

The caution was up. They were not in the middle of competing. Stewart hit the throttle, causing the car to kick out and hit the kid. I don't think he was trying to run him over, but he was clearly trying to buzz him rather than avoid him. Lots of drivers that witnessed the accident said the same thing. This is going places.

video looks preeetttyyyy bad..... ward did dodge another car essentially on the same line stewart was on, but Tony had to know of the guy's presence, and saw the guy, question is whether he only wanted to rattle his cage by coming as close as possible, and then perhaps the dumb kid took another step in that direction..... sincerely doubt tony intended to mow him over..... but he and the kid put themselves in the position of having no room for error.....
in 1985, i got mowed over by a jeep doing pretty much the same thing ward was doing; as some a - hole on st. augustine beach decided to "scare" us with his jeep (we were on foot). I scooped up some sand to throw at him and he was barrelling down on me, as i unleashed a sand fastball toward his windshield, he tried to swerve away but his jeep just plowed forward..... I jumped straight up at the last second when I realized i was gonna be hit, and his front bumper broke my rt leg, blew out my acl, his hood gashed my palm wide open, and it flipped me onto the hood, into the windshiled which i shattered, and then threw me end over end off his roof, where i landed in the sand behind the vehicle.......... lucky to have survived that one!!!!! just as the dick that ran me over was part to blame, so was I....... tho i won the lawsuit!

my point exactly, good analysis...... under the law of that state, will probably support a manslaughter charge. no way was it "murder".... depending on how the state defines second degree murder, it might get there...... this could very well end tony's racing career...... not only from the stand point of being in jail on sundays, but from the p.r. and emotional impact of what is going to come down on him from this.........

Everyone knows its a major no-no to get out of a car during a race. Also in the video where you "hear" stewart rev up his engine, its actually the cars coming by on the opposite side of the racetrack. The video is being taken from the opposite side of the track so you cant possible hear whats going on when stewart hits him.

After watching the video several times, IMO, I think the kid got clipped by the upper wing as he was leaning in to give Smoke the old fuk finger, and from there went down and then was clipped by the right rear tire.
Didn't see the right rear kick out as though Smoke was trying to scare him. Having been a crew member on a winged sprint car for a few years, the upper wing is obviously wide, but is also very low in the frontal area.
Anyway very tragic, and all sanctioning organizations should require drivers to stay in their cars, unless it is on fire, until safety personel are on the scene.
