On June 12, 2021, a federal District Court in Texas in Bridges, et al v. Houston Methodist Hospital et al, Docket No. 4:21-cv-01774 (S.D. Tex. Jun 01, 2021) dismissed a case challenging a hospital’s mandatory COVID-19 vaccination policy for employees. This is the first court opinion addressing the ability of employers to require employees to be vaccinated against COVID-19. The decision is also notable in that it rejects the argument, which has been advanced in other cases challenging mandatory vaccination policies in the employment context, that such policies are prohibited by the federal Food, Drug, and Cosmetic Act (“FDCA”).
According to Judge Hughes, that Supreme Court precedent means that employees can be required to get vaccinated without violating public policy. Judge Hughes reasoned further that the plaintiffs’ argument that the FDA had not fully approved the vaccine, making it against public policy to require someone to receive the vaccine, was without merit. The plaintiffs claimed that requiring them to take an unapproved vaccine amounted to an unlawful medical trial which is against public policy and violates an individual’s due process. However, Judge Hughes said that the emergency-use authorization that the COVID-19 vaccines received from the FDA makes them FDA approved.Comment -

#233At some point that will likely be reversed. Or another one will go through with a different argument. Personally, if I were the coach or anyone fired for not being vaccinated, I would use ADA and HIPAA as a major part of my argument. A person's vaccination record is considered HPI, which is protected federally under HIPAA. The fact that they said they fired him for NOT being vaccinated is a disclosure of his PHI. Unless they have a written consent to disclose such information, they technically are in violation of HIPAA. Asking to show he was is one thing. To broadcast someone's medical information without consent is a whole different ballgame. But that's just me and I am vindictive.
As part of that directive, the league says that all employees other than players (called Tier 1 and Tier 2 employees) are expected to get vaccinated unless they have an underlying medical or religious reason for not doing so.
Tier 1 employees include coaches and trainers and Tier 2 employees include general managers, assistant coaches and football operations employees. The memo states that any employee who refuses to do so without an approved reason will not be permitted to access the “football only” restricted area and they won’t be able to work with players directly or in close proximity.
UPDATE #2: Apparently Dennison has not, in fact, been fired by the team yet. The Vikings have released a statement that reads as follows:
The Vikings continue to hold discussions with Offensive Line Coach Rick Dennison regarding the NFL-NFLPA COVID-19 Protocols for training camp and preseason games. At this time, Coach Dennison does not have an exemption to the vaccination requirements of those protocols. We will adhere to the requirements of the protocols and of applicable law.
