I have no idea of the specifics of this particular case but I am going to go out on a limb saying it was a 5-4 decision with all the liberal justices voting it was unconstitutional with the 4 conservatives justices in favor of military commissions/tribunals.

The Supreme Court of the United States in 2007-8 had 4 liberals, 4 conservatives, and Anthony Kennedy who has had the reputation as a swing voter. Statistics have shown he, overall, leans conservative on his votes.



Plus, the Republicans can't complain about SCOTUS, 7 of the 9 sitting justices in 2007-8 were originally nominated by Republican Presidents.

Once again, its a complete guess based on the general behavior of liberals vs conservatives.

Republicans would have been a lot happier if Ginsburg and Stevens croaked sometime during Bush's 8 years. Unfortunately, they didn't.
