#13578On that day the U.S. Department of Justice seized the web domains and shut down the domestic operations of the three biggest online poker sites that were serving U.S. customers at the time – PokersStars, Full Tilt Poker, and Absolute Poker. The D.O.J. unsealed indictments which included both criminal and civil charges, and froze dozens of bank accounts associated with the sites. But as with many things related to the legalities of online gambling, the reality of what exactly did and didn’t happen and why, and the ramifications of it all, are a bit unclear.
What exactally happened?
Eleven people were named in the indictment, and the charges have primarily to do with bank fraud and money laundering, focusing on various activities of the three sites that facilitated payment processing from U.S. citizens after the passing of the controversial 2006 UIGEA Act.
The timing of the indictments and seizures did raise some eyebrows in internet poker circles as well as the general gambling world. The momentum regarding the legality of online gambling in the U.S., and specifically online poker, had recently begun to swing in favor of legalization, and this was particularly true in certain states.
Washington D.C. itself, ironically, had just recently legalized online poker within the confines of its district. And Wynn Resorts, which had retained state lobbyists in Nevada to work on the issue of online poker, had only a few weeks earlier announced an intended partnership with PokerStars. That partnership was hastily cancelled on news of the indictments.
What does this mean?
What’s on the immediate horizon at this point is not entirely clear. The Prohibition-like efforts of the DOJ has left a vacuum where a strong demand for internet poker still exists. There will, of course, be natural market pressure to fill the vacuum very quickly, and a number of smaller untouched online poker operators are still operational and taking U.S. players. These sites do have, at least temporarily, the opportunity to expand in the U.S. market as much as they dare to with little to no competition.
Some have speculated that lobbying by parties that would stand to gain long-term from a shutdown of the three big sites had influence in how and when everything went down.
The charges
One issue central to the indictments - and likely a critical misjudgment by the sites that were shut down - was their decision to actually invest in a small U.S.-based bank, to use for payment processing. The sites bought 30% of a bank in the state of Utah, and executed payment processing through that bank. An executive from the bank is one of people charged with money laundering in the indictment. Regardless of any arguments that can be made regarding the UIGEA and the former, current or future legal status of online poker in the U.S., the money laundering charges as a result of those banking activities are pretty clear cut.
Greatly enhancing the FBI’s ability to nail the targeted sites was the involvement of 28-year-old Australian Daniel Tzvetkoff, who reportedly processed over $500 million for various poker sites over a 2-year period. Mr. Tzvetkoff is rumored to have begun embezzling funds from the sites he was working with, which led them to turn him in to U.S. authorities, perhaps an ultimately ill-advised move by the poker sites for the long-term. Mr. Tzvetkoff began providing the investigators with a wealth of essential insight and information that allowed the FBI to prepare a thorough and relatively “easy” case against the three poker sites.
What does this mean for Online Poker?
In the end, the momentum towards legalization for online poker lumbers on, and most people in the online gambling world believe that relatively soon online poker will be legalized, taxed and regulated in the U.S., at least on the state level in various jurisdictions. Land-based casinos, existing compliant overseas poker sites, and possibly even other large mainstream business entities in the U.S. may try to get a piece of whatever pies become legitimately available.
As for the fate of the 11 named in the indictment, however, 8 are not presently in the U.S., and they have likely already disappeared to locales without extradition treaties with the U.S. They may permanently escape criminal charges, as long as they are careful to never accidentally set foot in the U.S. or any other jurisdiction with an extradition treaty.
The U.S. government will likely wind up with some money from the seized accounts, although far less than the $3 billion it is seeking from the poker sites in the civil suits. The DOJ recently released a statement indicating all player funds on deposit by U.S. citizens will be fully returned as soon as possible.
U.S. poker players now have the option to wait for legalization in the U.S., move out of the U.S., play at brick and mortar casinos with card rooms, or take a shot with playing at the lesser sites that are still operational in the U.S. But one thing that is clear is that the U.S. government has no interest in taking any action whatsoever against individual U.S. poker players, only against businesses they see as in violation of U.S. law.Comment -

Spike TV will have two exciting fights May 28, the first- Thiago Alves vs Rick "the Horror" Story and second in Demetrious "Mighty Mouse" Johnson vs Miguel Torres, fist and blood are bound to fly don't miss the action!
The preliminary fight card for this UFC 130 event will be aired on Spike TV, before the Main card comes on pay per view, May 28, 2011.
Thiago "Pit bull" Alves (18-7) vs Rick "Horror" Story (12-3)
Thiago Alves (18-7)
Their was a time not to long ago, when Thiago Alves was a serious contender for the title, but a brain injury and weight cutting issues that caused a year Suspension, slowed his career to a crawl.
Thiago has heavy hands, with knock out power in either one of them. Thiago also has a arsenal of flying knees and brutal leg kicks. He improved his take down defense to the point, where he was able to fend off take downs from great wrestlers like Matt Hughes(KO) and Josh Koscheck(unanimous decision) and beat both of them during a seven fight win streak.
The only time Alves got KO was by a up kick followed by punches from John Fitch in their first meeting in the second round. The seven fight win streak earned him a Title shot for the UFC Welterweight Championship vs GSP in July 11,2009, which he lost in a five round unanimous decision. Thiago has always had the talent to make it to the top but his weight cutting issues and brain injury put his career on the shelf for a while.
I think Thiago will be very motivated to show what he can still do, after the scare of almost never fighting again with his brain injury. He is fully healed from his brain injury and has had a great training camp in Florida with American Top Team. Thiago said, "he is in the best shape of his life and can't wait to see what he can do in the ring.
MMA Record (18-7) Wins 18 = 11 KO's 1 submission, 6 decision : Loses 7 = 1KO, 3 submissions, 3 by decision
Rick "Horror" Story (12-3),
Rick Story is a fighter out of Spanaway Washington, and he was a collegiate wrestler, at Southern Oregon University. He started fighting in the UFC in 2009 and had his first fight vs John Hathaway(15-1), which he lost via unanimous decision. His most recent win was vs undefeated John Hendricks(10-1), in which he won by via unanimous decision.
Rick's a big guy and is very strong like his opponent Thiago Alves, but will be over matched if chooses to stand with Alves and will need to take it to the ground if he has a chance to pull out a victory May 28.
I think Rick will have a tough time getting Thiago down, since Thiago was able to stop both Matt Hughes and Josh Koscheck at their take down attempts. That leaves Rick Story standing with Thiago, where he is at a big disadvantage with a in shape Alves who will be throwing a plethora of knees, kicks, and punches until one of them lands and ends the fight.
MMA Record~ Wins 12 = 3by KO, 3by submission,6 by decision : loses 3 all by decision
Pick : Thiago at (-210) and he is in shape and his weight cut won't be a issue, like it has been in the past.
The line: For the fight, current UFC odds have lister Thiago -210 ml and Rick Story +175. even with the juice at -210 I would take Thiago in this fight and i would jump on it soon before it goes way up! If it's already to high for your taste at -210, you could parlay it with Torres or your favorite fighter, but don't make it more then a two fighter parlay.
Demetrious "Mighty Mouse" Johnson ( 9-1 ) vs Miguel Torres (39-3)
Demetrious Johnson
Demetrious Johnson is a 24 year old rising star in the UFC. He is very quick and powerful with his hands. He is a powerful wrestler, who has won three of his fights by via submission. Johnson is coming off a big win vs highly respected Japanese star Norifumi Yamaoto. In The fight, Johnson used his superior wrestling ability to take the fight to the ground, where he controlled the first two rounds and ended up winning the fight via unanimous decision.
Johnson was scheduled to fight on this card at first vs Renan Barao, but was moved into this spot to face Torres, after Brad Pickett was injured and withdrew from the fight. In fact, Johnson's only loss was to Brad Pickett in a 3 round unanimous decision. Johnson's dominance on the mat might be meet by the fact that Torres is a submission specialist himself with 23 submissions on his record. This fight should be a great fight but the lack of experience in Johnson's corner might hurt him.
MMA Record~ Wins 8: 2KO// 5 submission// 2 decisions ~ loses 1 by decision
Miguel Torres
Torres hadn't lost a fight in six years at one point in his career. He had won 17 straight fights and 19 of his last 21 fights. Miguel Torres is 30 years old and was the former Bantamweight Champ of W.E.C., before he lost his title to Brain Bowles Aug. 9th, 2009(four fights ago).
He lost his next fight to Joe Benavidez in the second round via guillotine choke, making it his first two consecutive loses of his career. Torres got back on the right track by winning his next two fights over Charlie Valencia and Antonio Banuelos. Torres is a Black Belt in Brazilian Jiu Jitsu and he trained under Carlson Gracie, from whom he received his black belt.
Miguel recently switched trainers to Firas Zahabi, who is the head trainer of GSP and the head of Tristar Gym in Canada. The move to Zahabi as his new trainer should be beneficial for Miguel, who at one point trained himself for fights. Miguel has 23 submissions to his credit and 9 KO's and he will be a tough challenge for Johnson; come the May 23, 2011.
MMA Record ~ Wins 39 : 9 KO// 23 submissions // 7 decision ~ Loses 3: 1 KO// 1 submission// 1 decision
The pick: Torres with a new trainer (Zahabi) should help him get on top again. he has to much experience for Johnson and that will be the difference in this fight.
