Yes by all means agitate your boss by asking him to "prove it". Most companies have personal appearance clause for employes and it doesn't have to be any form you signed. Shave if your boss tells you to shave or go get another job.

When you were first hired, you probably signed a company policy stating you would abide by the dress code. It might state that you must beat neatly trimmed or that you may not maintain facial hair.
If this is something new and you have been at this job for while, i would ask for a copy of the company polices. If it states that you are not in accordance, then you can be terminated for failure to meet company standards. If they do not have that policy, then i am sure your boss would write up one. it would not be valid until you signed it. He could fire you for not signing it, but you would be eligible for unemployment due to the fact that your company is changing their policies.
The state you live in plays a role too. In Colorado, you can be fired for no reason at all. If you are fired for race, sex or religion, then you can have a legal case, but they are not required to give you a reason.

In the day I worked for a company that required no facial hair and no hair more than one quarter inch over the ear. I hated it but I also needed the money. That company was Disney. Things are easier now. Still if your being lazy and coming in with three day shadow your boss is probably doing his job. He has to answer to someone also. So shave or get a different job.
