I love this line. "Here in California you would have to complain at the tribal gaming commission which is made up of the same tribal members who own the casino." Which more or less means she's screwed.

The jackpot when won is then paid by the manufacturer.
It's great publicity for a casino when a jackpot this large is hit, and the casino loses nothing.
It's obviously a lot of negative pr for a casino when something like this case occurs.

As far as the malfunction, there have been a number of cases like this which have gone to court. I believe the manufacturer has always won.

Nativediver - "If I was that lady I would have taken a picture of the machine with my cellphone get as many witnesses.."

                This is good advice.

Nativediver - "...and take that casino down for as much as they will cough up. Lawyer up bigtime and they unleash some green, it may not be 42 mil, but its better than a fricken ice pick in the eye."

Hopefully the casino will pay out something more than $23 if she takes them to court in order to shut her up and stop the bad pr.
It won't be even 10% of that jackpot amount, though.
She may be able to get about 1% of that amount, and her contingency lawyer will get 1/3 to 1/2 of that.
If this happened at a Native American casino, no lawyer will even bother with her case if it's to sue the casino, as it's under "Tribal Law" and the same people who own the casino will be judging the case, as someone has mentioned.

At a non-tribal casino, I overestimated what a lawyer could get her - I'd put the over/under at a 20k - 40k settlement, but closer to 20k, which the casino may pay out just to close out the bad publicity.

But her best bet would probably be to sue the machine manufacturer, as this had to be a pooled jackpot game which the machine manufacturer administers.

The litigation would likely have to be against the manufacturer and not the casino, no matter where it occurred. They are the ones responsible for verifying, authorizing, and funding the jackpot. It is also their equipment that seems to have malfunctioned. I don't know how the casino itself could possibly be held liable. They have almost nothing to do with it outside of day to day maintenance (which likely wouldn't cause the malfunction).

I think all the people who lost money in the machines need to claim a malfunction and ask for their money back. Without knowing more facts, it's hard to say how this will turn out, but I think the casino is going to have to pony up a little more.

Her worst mistake was accepting the free BS they offered. They probably had her sign some sht too. I would've been getting all the people's names there and phone numbers to testify for me. I would have politely declined all free things offered by casino.

I guess you guys really don't understand that it's not the casino's call. They have NOTHING to do with the jackpot. Someone from the manufacturer comes in to verify that the jackpot was authentic. If it is, they are handed a check for $100,000 I believe, and then the details of payment are sorted out with a representative of the company (whether it is paid in a lump sum or yearly, etc.).

                                      bastards didn't have it anyway:

osted March 8, 2010, 12:07 am MT Fortune Valley casino owner files bankruptcy

Centaur Gaming, the parent company of Fortune Valley Hotel & Casino in Central City, has declared bankruptcy.
The Indianapolis-based company, which also operates Hoosier Park Racing & Casino in Indiana and Valley View Downs & Casino in Pennsylvania, issued a press release Saturday stating that operations would not be impacted. The company filed Chapter 11 to restructure debt, which apparently includes $250 million in licensing fees connected to Hoosier Park.
“Hoosier Park and Fortune Valley are healthy, successful businesses,” said Jim Brown, General Manager of Gaming, Hoosier Park Racing & Casino, in a statement.
Fortune Valley is the largest casino in Central City.

and who do you think the state is going to side with? the illegal alien or the casino donating thousands of tax dollars a day?

i'm going to start putting my jokes in this format cause libs on this board are too fukkin stupid and conditioned to recognize it.

I'd say she gets the 42k that she thought she won and she's happy with that. Such bullshit though, here this lady thinks she has hit a life changing jackpot only to here it was a mistake. She probably accepted the free night hotel stay thinking they would sort out this mess and pay her the money she's owed. I don't think she gets more than 42k.

When someone puts money into a slot machine and the bells go off, that means they win. This woman is being ripped off big time. I cannot believe this casino would say there was a malfunction of the machine. Everyone around her saw that she hit the 42 million.
She needs to get herself a good lawyer and fight for what she has won. All of a sudden, the machine was hit for 42 million and it was just a malfunction? They offered her a free room and her $20.00 back? Fight for your 42 million, you won it, you deserve it!!!!

Well when a jackpot like that hits thye have to not only checkj the machine but they have to call gaming to check it and the maker of the machine to check it, usually this can not be done in less than 4 hours. If these steps were not taken I would have to ask why ......she may have a big payout coming

That's the most likely case. Yet, many people will defend the casino saying the machines are not rigged and casinos don't cheat, using the argument the casino would lose their license. Yeah, right.

Uhh. The machines have random number generators to produce the payouts. The manufacturer checks to verify that the algorithm actually produced the win or if some sort of reel malfunction or other sort of glitch caused the machine to produce what seems to be a jackpot win.
