Thats the thing that I am struggling with... The Pro's and Con's of taking it to trial and what I have to deal with if for some reason I am found guilty. We would request a bench trial and basically make the DA prove its case which is 50/50 at best I think. I am just really pissed and would feel so much better if I was found not guilty or the case was ultimately dismissed. I gave my lawyer the $3k retainer and told him to take it to trial. We're hoping the DA realizes were not ****ing around and will eventually dismiss it. BUT, if it does move forward we might back out at the last minute and just take the ACD.

My lawyer told me I have 2 weeks to decide and he'll give me the retainer back if we decide to take the ACD. This shit has already cost me $1k in lawyer fees and $5k bail which I will get back at next weeks hearing... If I was broke and couldnt get a lawyer I would easily get royally ****ed and be forced to plea to a misdemeanor, this experience has really made me hate cops and legal process sooooo much!!!!

Its tough because I am so pissed about how this went down but at the same time have to take a step back and realize what COULD happen if I dont just take the ACD and be done with it. I would rather not have to go through life (I'm 26) with a Misdemeanor Assault charge

OH and the cops have pictures of the dudes mouth with the teeth knocked out. My lawyer is trying to get copies, if I get them I will post them for you fukkers!!

In a he said/she said, all we know is one guy ended up with his teeth knocked out. I find it hard to believe there is enough (any?) evidence to justify that whipping. If it went to trial, you'd stand a pretty good chance to be hit with that misdemeanor assault charge, stick or no stick.

You may (you have to check this out in your state) qualify to get that charge expunged a year or so from now, if you decide to take it. Look into it.
