Texas law says the following.
Parent/stepparent/person standing in loco parentis to child is justified to use non-deadly force against a child under 18 when and to degree the actor reasonably believes necessary to discipline, or safeguard or promote child's welfare. Penal § 9.61. [Criminal Code]

He definitely used force but no jury will ever say that it was deadly.

Something smells fishy in this AP thing. The grand jury that indicted AP was overseen by a "random" jury foreman was actually chief deputy clerk and court administrator for Montgomery county, the county he was indicted. Plus the second allegation was a case that was dropped because they couldn't get an indictment so "someone" leaked that to the media.
