#250The guy he hit was also drunk, an illegal alien, and was jay walking at night, wearing dark clothing. One of those 50/50 fault cases. Paid a hefty amount to the family.Comment -

#251Re: kid video, I think a doctor would tell u that adolescents have advantages to survive trauma accidents like that.Good blood flow, unusual flexibility.Doctor would give better explanation. But ability to withstand things is unusual at a young age.

#252No current evidence supports "criminal intent" says the local sheriff....so it really doesn't matter what some guy says who sitting in the stands.....people are going to jump to every crazy conclusion there is...every local driver who races will tell their tall tale and what Tony was thinking at that "very second"....but in reality it was just a friggin tragic accident that shouldn't of happenedComment -

#253Sprint car racing is my favorite type of racing. I've covered sprint car racing for the local newspaper for about 15 years and I've been to thousands of races. I returned home today from 10 days in Iowa attending the biggest sprint car event of the year. Tony was there earlier in the week. Ironically, a car owned by Stewart won the biggest race last night. I followed Tony long before he went to NASCAR and have talked with him one-on-one on several occasions. A friend of mine is the guy who Tony credited for saving his leg following his accident last year.
One thing I can't understand is that the most-used eyewitness account mentioned in this thread comes from a friend of Ward's. A view from Tony's biggest fan in the stands there would be just as credible.
I'm pretty sure that I have a good idea regarding what happened. But I'm not 100% sure, so it really doesn't matter.
The only one who knows exactly what happened is Tony.Comment -

#254You do see drivers get out of their cars in the middle of the track if they've been wrecked, ive seen it happen a number of times, but not once has one of those drivers been run over.Last edited by packerd_00; 08-10-14, 07:56 PM.Comment -

#259Could be expensive settlement. The family will likely argue the kid could have made it to the sprint cup and made millions.
Who knows how this will play out. I have heard rumors of a go pro that is yet to be turned over to police.Comment -

#263OK let me ask another question. Why did this driver decide to walk in the middle of the track when all others stayed in their cars? Was his car on fire and he got out so he won't get burned? Did they say why he had to get out of his car?

#264Stewart was in no danger of ever going to jail unless he publicly threatened this kid or showed intent to hit him. I would argue that even then Stewart has too much money to not get off any rap like that.
The guy died, on a racetrack. Drivers assume the risk that they can die when they turn on that vehicle. On top of that, this kid was wildly negligent by getting out of his racecar in the middle of a goddamn race.
Stewart was never in danger legally. Mentally - sure. It's hard to come back from shit like this.
The estate can try and sue civilly, but due to the higher standard applied to drivers, it's going to be really difficult to prove negligence on the part of anyone but the victim.Last edited by ChalkyDog; 08-10-14, 09:38 PM.Comment -

#266Me posting as Pavyracer: "Let me ask a few more questions. Why did the driver walk over and confront Stewart; why not drive? Do the cars even have brakes? Why were there lights on the track when it was clearly nighttime? Hi I'm Pavlos and I am so bored with my average wife and average life that I come on SBR and ask stupid questions in a lame attempt to stir things up."Comment -

#272my opinion is that he should go to prison on involuntary manslaughter charges. if you have seen the video, it looks like he fishtailed it out a little on purpose. i think in his head and in the moment he was thinking he would scare him a little or maybe he was trying to tap him with the back of his car. he didnt want to run him over, but thats what happened. i cant believe he had the option to race today as well. any sponsor that sticks with him is going to have this incident attached to them. i can understand why the other driver was mad. i cant understand why tony stewart had to be driving that fast and that close to him. he could have been driving at 2mph and turning away from kevin ward instead of hitting the gas and whipping the back towards him. like a poster said above, if stewart is a normal human being he will either be haunted by this for the rest of his life or he will man up and admit that he made a mistake and accept the punishment that accompanies that mistake.Comment -
