    Gambling Law Interview with Professor I. Nelson Rose, Gambling Law Expert
    SBRtv conducted an interview with Professor I. Nelson Rose, a world-renowned authority on gambling law.

    This initial interview is in three parts, and Professor Rose has agreed to do follow-up interviews to address issues of interest and questions posed by SBR posters. So if you have any question at all about the legalities of online sports betting, please post them in this thread, and we will try to address them in future interviews with Professor Rose.

    In Part 1, Professor Rose discusses what he does and how he came to be a gambling law specialist. Look for Parts 2 and 3, coming out in a few days.

              Are U.S. citizens actually required to file a FABR on their taxes if they have over 10,000 total in offshore GAMING accounts?

                            Q- If you win good amounts of cash every year and you choose to ignore taxes in the U.S- what is the likelihood of getting into trouble with the law? How far would they go to try and prove you are violating laws? Has it been common? or becoming more common?

                            I entered in this industry with the intentions of paying taxes on winnings but after being stiffed a huge amount of cash from a book and now knowing that none of the money in any of these books can ever truly be safe and that it all can be taken away at any time I will not be claiming anything until things are regulated and safe. So basically I would deny ever even placing wagers online at this time as far as the government is concerned.

                              As a Law Clerk, I basically do all the research for guys like Mr. Rose. Behind every lawyer is a team of people working, behind the scenes ensuring that lawyer doesnt fail. Teaching law in Macau must be pretty exciting.

                                      How important is jurisdiction for sportsbooks to avoid prosecution from the US government?

                                      Recently the US government has been enforcing laws internationally against citizens in other countries for breaking american laws (for example Marc Emery broght from Canada to the US to face charges for selling marijuana seeds). Could operators of online sites that accept american players face a similar fate?

                                          I second Fishhead's question about *FBAR* (Fishhead said FABR). I DEFINITELY want to hear his answer to that.

                                          I have a few more:

                                          1. Is he aware of any case where someone placing a bet, online or offline, has been prosecuted in the United States? Is the enforcement solely geared towards the bookmakers? Is online betting going to continue to be in a gray area?

                                          2. With the recent partnerships between the Fertittas and Full Tilt as well as Wynn and PokerStars, in addition to the noise from California (and occasionally the US Congress) about legalized online poker, I was wondering how he sees the future of online poker?

                                          3. With the recent announcement by the Nevada Gaming Commission allowing non-sports event betting (such as betting on the Academy Awards), does he see that coming under heavy scrutiny or will we have Oscar and American Idol betting next year?

                                          4. Does he see legalized gambling on politics coming at any point in the future? As he knows, Intrade does a lot of volume on the popular contests, but they're located in Ireland and exist in a legal grey area. As we move forward, and gaming becomes more accepted and perhaps legalized, does he foresee the CFTC becoming involved with gaming or will the Federal government need to form another body to deal with regulation and arbitration?

                                            Q: Should online gamblers file their winnings on their taxes? Didn't the only guy who ever went to court over online gambling, was discovered by the authorities only because he was filing his winnings on his taxes?

                                                      1. I definitely want to know what Professor Rose thinks about Wynn and his new endeavor and does he think it will be successful and what are his opinions on what he wants to accomplish.

                                                      2. Also, what does he think the real reasons for opposition in the congress to gambling. Congressional leaders opposition like Bacchus and his opposition? Is it money driven or just puritanical Biblically driven opposition?

                                                      3. Many native american groups don't want legal online gambling, what are his thoughts on that opposition?

                                                      4. What are his opinions on Asian gambling and Macau and the future of gambling in Asia?

                                                      5. Does he have any opinion on gambling and its future in Costa rica and the Caribbean, and gambling in the Western hemisphere( at least in the americas) Gambling's future on the the United states mainland ?
