The mistake you are making here is assuming that saying Obama will win is the same as saying Obama SHOULD win. It is not. Not one single American has ever been criminally prosecuted for betting online. Millions and millions of Americans play poker online and use sites such as Intrade, Bookmaker, etc. There is NO LAW that states it is illegal to gamble online as the UIGEA only limits your options as to funding.
