Well some pretty simple points:

Is it a "thing" or an "idea" ... "Things" as in physical things more than likely need patents before copywrites... "ideas" are protected with those, but are MUCH easier to beat... hel everything worth fighting for can practically beat patents and copywrites but at some point it's worth the min investment...
