Fort Myers resident and New York Mets pitcher Johan Santana has been slapped with a lawsuit in Lee County from a woman who claims he impregnated her during an alleged rape in 2009 in south Fort Myers.The woman, named only as “Jane Doe” in the lawsuit, filed Tuesday, alleges that on Oct. 27, 2009 Santana forced himself on her, despite begging him to stop. The lawsuit, filed by attorneys from Palm Beach Gardens and Denver, asks for unspecified monetary damages.


According to Lee County Sheriff’s Office documents, the woman alleged that Santana sexually battered her on a south Fort Myers golf course last fall. The documents indicate Santana and a woman friend were walking on the golf course at the Renaissance gated community Oct. 27, when Santana began to kiss her and pull up her top, unclasping her bra. The woman, who wasn't identified, said she told Santana she didn't want to have sexual relations with him, but he continued to persist.

The woman told deputies Santana then forced her to have sex with him on the golf course, although she repeatedly told him “no.” Afterward, the woman walked back to the tennis courts with Santana, and stayed there while Santana played tennis. She reported the incident to the sheriff's office the next day.

On Dec. 8, the sheriff’s office cleared Santana of wrongdoing, citing a lack of evidence to prove the accuser didn’t give consent and statements inconsistent with witnesses. The State Attorney’s Office declined to prosecute, citing insufficient evidence.

The lawsuit alleges the incident included Santana grabbing, oral sexual battery, exposing himself, forcing contact of his genitals and forced penetration with the woman.
“The illegal and cruel acts perpetrated by Johan A. Santana against Jane Doe, including...luring Jane Doe by use of false pretenses to a remote, outdoor area in order to commit premeditated crimes against her.”
She claims the encounter has caused her to suffer from depression, psychosomatic disorders, mental disorders, anxiety and panic disorders and other mental and physical injuries.
Santana is married with three children and lives in south Fort Myers.
