Not true. Gambling isn't illegal and neither is placing a bet online in the States. It's the online transfer of money relating to gambling that is illegal. A tout isn't doing anything illegal either. They're simply offering picks. It's when someone chooses to shift money online that the law is broken.

Edited to add - the only thing I could see SBR facing any grief over at all would be an intellectual property issue if someone is copying and pasting a tout's plays word for word. And even that would be a longshot at best. But I'm sure the guys in the service forum are on the ball enough to quickly figure out a way around posting the plays and units without ruffling anyone's feathers.

It would not be a criminal action it would be a civil suit for damages for breach of contract in disclosure of intellectual property. Most of the tout agreements have a liquidated damages section that states what is owed if a breach is proven. There's probably an agreement that the intellectual property is unique of difficulty to value so that's why a flat number is picked.

The difficult part for the tout is proving the case and obtaining jurisdiction over the alleged violator. There's probably an indemnification clause in there for atty fees too. So long as SBR doesn't sell out it's posters this will remain very difficult and be idle threats.

Is this true that SBR have received a lawsuit, or cease and desist? They shouldn't complain this forum most likely obtains more purchases and notoriety than not.

Assuming that SBR is based out of Costa Rica, wouldn't any lawsuits be under Costa Rican jurisdiction? And if that is the case, good luck with any tout trying to sue anybody in CR.
