WHAT is Mail FRAUD --- Is this MAIL FRAUD ?

So just to keep this short, I bought a roll of silver quarters through an auction site - it wasnt Ebay.

I paid the guy $180 by sending him a Money Order. I got nothing, and he isnt responding to my messgaes.

So now, is this mail fraud like a federal crime, or is this just a civil case where I would have to sue him in court.

The mail system was used to deliver the money order, but it was not a postal MO.

It wasnt EBay. They only do paypal payments so this cant happen.

It was actually IOFFER. They wont do anything since I didnt use paypal.

I dont know if its worth calling the FBI or do I just have to go to civil court

Google says mail fraud is anything where the postal service is used, but then it seems to imply just sending a letter isnt enough. Seems to imply that payment must be made by postal MO to be considered mail fraud

Yeah I shouldnt have. I took a stupid risk, guy had like no feedback too. I am stupid.

Small claims - no lawyer.

Either way, I would just let it go. He lives 10 states away.

Just thought if its mail fraud, then get the FBI involved, he would get scared and pay me back

Im not claiming to know, but that seems like alot for $10 in silver quarters. What the hell would you have done if he had sent you $10 in quarters & they were after '64? This had bad idea all over it

Yeah they were BU 1940's quarters and it was when silver was like $19.65.

Spot was like 14.5X. I paid 18 X to cover shipping and the fact that they were supposed to be BU 40's.
