    Challenge To Online Gambling Law For NJ Court

    Hardbeatnews, WASHINGTON, D.C., Tues. Sept. 25, 2007: A federal court in Newark, New Jersey is set to today hear another legal challenge to the Bush administration's 2006 online gambling law.



    The U.S. Justice Department is hoping US District Judge Mary Cooper will reject a gambling industry motion to block the law before it goes into effect.



    The Interactive Media Entertainment and Gaming Association, or iMega, is challenging the Unlawful Internet Gambling Enforcement Act that makes it a crime for banks or other institutions to process financial transactions, such as electronic fund transfers, that are used to place bets online.



    The group, which represents the online gambling industry, says some of its members face "imminent financial ruin" if the law is enforced.



    But the US DOJ brief said the group has no right to bring the case and is basing its claims on "rank speculation" and premature conclusions because the federal government has yet to issue regulations that was passed by Congress last October.

    But the plaintiff’s insist, "The action of gambling in private on the Internet is protected by First Amendment privacy concerns."



    The Treasury Department and the Federal Reserve missed a July 20 deadline to implement the law and are still drafting regulations.



    The lawsuit comes as Antigua is seeking US$3.4 billion from the U.S. at the World Trade Organization for potential income it says it could lose in the online gambling sector if the US fails to cooperate with trading laws. – Hardbeatnews.com
