    State of Florida files legislation to legalize online gambling


    It has long been rumored that the state of Florida could be one of the first in the nation to regulate online gambling. On Friday, Representative Joseph Abruzzo filed the Internet Poker Consumer Protection and Revenue Generation Act of 2010.

    The legislation outlines a fully regulated system of online gambling in the state. If approved by lawmakers, Florida would be the first state to use rules from the Unlawful Internet Gambling Enforcement Act of 2006 to help regulate Internet gambling.

    The UIGEA was put in place by US lawmakers back in December 2006 with the intent of ridding the country of online gambling. In the years that have followed, the industry has grown instead of shrunk.

    One area of the UIGEA allows for states to lawfully regulate and conduct intrastate Internet gambling, such as poker. Abruzzo's legislation, which was filed Friday, takes advantage of that clause.


    Safeguards for players have been one of the main reasons that Representative Barney Frank has proposed legislation to overturn the UIGEA. Currently, millions of people in the US are gambling online at sites that are not regulated by the government.

    In Florida, any licensee would have to ensure that the player is protected not only against fraud, but also against themselves. Gambling addiction is one of the top problems for lawmakers looking to expand, and Abruzzo has covered that in his Bill.

    The Internet hubs must put limits on how many deposits and how much a player can deposit each day. In addition, a limit must be placed on how much a player can lose in a set amount of time. A time limit on how long a poker player can play in one session will be required as well.

    The percent of taxes on the winnings is always another issue that lawmakers grapple with when creating gambling laws. In the Internet Poker Consumer Protection and Revenue Generation Act of 2010, Abruzzo has laid out a plan for twenty percent of the winnings each month to paid in taxes.

    Whether or not the legislation filed Friday passes or not will depend on lawmakers' ability to see the future potential and reconcile their differences on the Internet gambling issue.

    German Man Arrested For Running Illegal Online Poker Processing Empire March 1st, 2010 Author: B. SolomonMichael Olaf Schuett has become the target of a federal investigation after it was discovered he had allegedly transferred over $70 million in online poker winnings to 23,000 mostly American citizens, since 2007.

    The authorities were first alerted by bank staff whose suspicions were aroused when customers started trying to cash large cheques from Schuett’s company MCM Capital Management at the bank, claiming they were their online poker winnings payments.

    In the meantime, FedEx employees too became suspicious after noticing the high number of packages being mailed from Schuett’s home address, and a federal complaint noted: “Federal Express employees became suspicious of Schuett’s activity when Schuett began mailing over 150 parcels per week. FedEx employees opened several of the parcels and determined that each contained a check.”

    So far, the investigation has determined Schuett had been using at least 40 accounts he had opened at the Bank of America, as well as numerous accounts with Wachovia, Shamrock, CNL, Fifth Third and Northern Trust Bank of Miami to receive wire transfers and transfer funds to over 23,000 online gamblers.

    In addition, Schuett was the registered agent of a network of 424 businesses throughout Naples, Tampa and Bradenton State, including MCM Capital Management Corp, MI Global Inc, South Naples Escrow Co, Southwest Florida Payroll Co, Woodhouse Systems, Mathew’s Trade Corp and Internet Payment Services Group Inc.

    Schuett would use his companies as fronts to carry out his money transferring operations, despite never registering himself as a money transmitting business. When questioned by bank staff as to the nature of his business, Schuett tried to pass himself off as a real estate investor.

    Following the investigation, German citizen Michael Olaf Schuett (29) is now being held at Lee County jail without bond while agents execute search warrants, seize his computers and numerous assets purchased by his alleged illegal online gambling related activities.

        Since they were from Fed Ex and not USPS, I dont think any laws were broken opening the packages, Im sure in the fine print somewhere Fed Ex says it can open any suspicious packages,JMO.

            A package containing a check is suspicious? Since when? I think the Fedex employees were looking for cash and when they found the checks they called police. Bastards!

                Hope this happens! I can go down the street to 4-5 casinos and play poker whenever I want, but I prefer playing online everyday.

                  Exactly. Here is what happened. They opened the packages thinking it was cash. If cash was in the packages they would have pocketed it and no one would have known. When checks were found they couldn't cashed them and they couldn't tell the customer we opened your packages and we found checks because he would have been pissed so they ratted him to the cops.

                      heard on the news not long ago there is some kind of legislation being pursued to legalize gambling in here in GA.
                      Its geared towards casinos though I believe.

                            What I don't get is why the goverment doesn't capitolize on this. With the economy being what it is and the federal debt being what it is why wouldn't the goverment both legalize and TAX online gambling? I would suggest they open their own online site and reap the rewards at both ends even. It only makes practical sense to legalize gambling and tax it though. 100's of millions if not billions of dollars a year would be generated through this.
