Some days I love being a lawyer...
I don't do it fulltime - just recreationally taking cases on referral.

Case I just got: The defendant just got out of jail for alcohol/drug charges. To celebrate, his friends take him out to a bar. On the way home, he smashes his truck into my client's vehicle at about 30mph without slowing down. He flees the scene, but his truck only makes it a block. After he's arrested, he blows a 0.26 BAC.

I'm not saying anything about my client - but the facts in this case make it fun. With cases like this, I hope the insurance company lowballs, so I can tell my client in good conscience to go to trial... This kind of case is a blast to try to a jury.

Insurance Companies are Robbers in suits....I love how AllState and State Farm through their respective marketing campaigns make it seem like they paid all their homeowners insurance polices after Katrina for wind damage...Roof blows off the house everything gets soaked and ruined...Insurance company only pays for roof not everything beneath it...Damn thieves they are...Many people paying upwards of 25 years or more on their polices and got next to nothing after the adjuster showed up...State of Mississippi had to file a class action just to get them to pay some of those policy holders what they were more than entitled to...bAstards that they are

I love it, I go to court on traffic offenses just to watch the legal system in action. I can't wait to be called for jury duty. I always wanted to be a lawyer coming up, but I realized in high school I didn't have the discipline or smarts to do it. I work in the biotech field now but I always think about taking some classes involving criminal justice and maybe trying to land a job with the courts or even a paralegal job. It's just so damn interesting.

Not all lawyers are tax lawyers. What is your point?

Or more precisely what was the purpose of your original comment? Justin relayed a story about a stupid individual that he read about today. The premise was that he is representing one of the parties, but he specifically said he doesn't practice full-time - "just recreationally".

You responded with, "so you make a living off other peoples misery congrats."

What about the word "recreationally" don't you understand? I mean, you're a smart guy so I'm not trying to condescend here, but what does your response have to do at all with what was posted?

                                      Thanks in advance....

yes, and the US plan to take care of the nations medical needs is to force everyone to buy insurance. What a country.

If a cop has probable cause, the State can force you to do a blood test. They won't do this on a random pullover, but they would if there were an accident and you refused a breath test.

refusal to blow here in GA is automatic DUI.
but you can hide out until the next day and get a hit and run. which than can be dropped to reckless driving

In Indiana, a refusal to blow causes an administrative suspension of your license, and the refusal is admissible. The only time it makes sense to refuse is if you are borderline - at 0.10, you might be 0.06 by the time they take you to the hospital and take your blood.

If the defendant just got out of jail he probably does not have insurance and the truck was probably not his, maybe stolen, the guy just got of jail, he has no job, no money, thats why he was trying to flee, he probably did this because he missed his girlfriend and cell mate and wanted to get the max jail time, he is not stupid
