innocent people released from prison after years.
Should they have the time served on credit toward the commission of future crimes?

Yes, I see this being enacted into law just as soon as SBR starts awarding posters points for future log-in's and blogs that they're going to write.

They should put in jail the jury or the judge who put them there in the first place for the same amount of time.

No... the "wrong place, wrong time" doesn't hold water. Most of them were probably up to no good, anyhow.

I would vote for the overzealous prosecutors possibly, but the judge and jury? Really pavy?

The ultimate decision rests with the jury if it's a jury trial or judge if it's a judge trial. The proceturor doesn't hand out verdicts or sentences.

So with this law being enacted quite soon, if you were to have say 20 years credit towards future crimes committed, how would you use this.

Would you commit a bunch of tiny crimes. Say like punching the douche at the video store who keeps adding false late fees onto your account, or taking your stuck up neighbors Benz for an off road joy ride without his permission and leaving the bodily fluids of random prostitutes on the upholstery.

Or would you save the credit towards a really big crime. Like an armed robbery for when you get barreled into the street bookies.

There was actually a story about this situation around here recently. My exgirlfriend's grandfather was the defense attorney back in the 80's for a man that was accused of raping and killing a girl that lived down the street from him. Evidently no one believed that he was innocent except for his attorney. The story goes that this trial was the thing that actually led to his death because it was so stressful and he put much into the defense.

In the end the client was found guilty and sentenced to prison for a long time...it might have even been life. Well just this passed year they introduced DNA evidence from the crime that proved that it wasn't possible he was the one that committed the crimes. He was actually released and is living a somewhat normal life again. Obviously its pretty bitter sweet to him at this point because such a big chunk of his life was taken away from him. Of course he is thankful that he does finally have his life back and was set free from a crime that he didn't do in the first place.

Its a pretty messed up situation but the problem is that he doesn't really have much of a recourse against the people that put him away originally. I guess he could sue them in a civil court and be compensated monetarily but obviously that will never give back the years of his life in which he was in jail.
