Attempted Murder.

    Attempted Murder.
    I'd like opinions on this situation. It's all real, as insane as it might sound at times.

    A woman I know (22, attends a popular US college), we will call her Mary, was at a friend's house one day. We will call her Sally. The friend lives with 3 other people, another girl (also friends with Mary, we will call her Laura), and a man and a woman who are a couple. They have been friends for years, and were hanging out. The man comes downstairs as Mary and her friend Laura are watching television. He watches for a bit, and leaves. This is where the situation starts.

    The man, we will call him Jim, texts Marry, who is in a relationship, as is Jim. He asks if she wants to become **** buddies with him. She replies no, and thinks nothing more of it. She tells Laura who says he asked her 2 months ago, but she said no. Mary calls and tells me and I told her to tell the girlfriend when Jim was doing, since it was the right thing to do. Mary tells Laura she is going to tell, and Laura tells her not to, because it turns out Laura actually did accept his offer and they had oral sex a few times, so that was her reason to hide the truth.

    Anyway, Mary tells the girlfriend. The girlfriend calls Mary a liar, and Jim starts texting Mary things like "you are a slut" and "you should have said yes" and "you are going to get what you deserve". I instruct Mary to tell him to stop texting, or she will pursue criminal action on him. He says "go ahead". The next day Mary goes to the police, but due to the lack of physical evidence (only the texts), they can't file a restraining order. Mary also blocks Jim's number.

    That was several weeks ago. Today Mary was visiting family, get a call from her landlord that there was a break in. Someone had broken into her condo, which is broken into an upstairs and downstairs. The person who broke in used an axe to break down her neighbours door, took one step in, and turned around and went into her place. The man then entered her place, and walked around moving things. He never entered the bedroom. He did have a glass of water and the police said he left "bodily fluid" on the desk (either saliva or semen, probably semen). The man stole nothing from either condo.

    The man was seen fleeing the scene holding an item (gun or the axe). So, Mary calls me and tells me and I mention Jim, and she says he sounds like the man fleeing the scene. Mary then gets a text from Sally (not the one who accepted the **** buddy offer) saying "he did it, I'm coming over, need to get out of this situation".

    Anyway, I told Mary that she should go to the police and file for attempted murder. He has a history of hostility towards her and broke into her place with a weapon with no intention of stealing. So, either he knew she wasn't home in which case he was watching her, or he didn't know she was home, and broke in, armed with a weapon and aroused. Attempted rape, assault, murder, all seem possibile with someone that unstable.

    What do you guys make of it?

        Sounds more like Break and Enter than attempted murder. How can you attempt to murder someone if they are not home. YOur friends situation is not good as he sound psycho but it hasn't been attempted murder YET.

          It reads like an SAT question.

          But yeah, she should talk to the police, and they will likely recommend at least a restraining order.

            I think all he can be charged with is the breaking and entering. Possibly aggrevated stalking. Which means, he could end up being more dangerous.

                Why would someone break and enter into 2 condos and not steal anything? Not only that, he broke into one and only left one muddy footprint, so he didn't even want to bother going into her neighbour's place. Just hers.

                Those don't do anything, make things much worse. I'm trying to figure out how to make this situation hurt this guy, like it should.

                That's the issue. He entered her premises, specifically hers, with intent to do what? Masturbate? Did he just do that because she wasn't home? If she was, then what? What if he thought she was home, and settled doing that because she wasn't?

                    A restraining order is a piece of paper only. Protect this young lady, because the police cannot be with her every second of the day. Last I checked you cannot arrest someone for acting a fool without them doing anything physically to you.

                      Mary, Sally and Laura? Where were Betty, Susan and Margaret when all this happened. First thing to do write the story and use broads names that dont instantly kill an erection.

                        that would only be 2nd degree burglary and the police do nothing. The piece of paper will not protect her period. You need to tell jim to leave her alone or you will kick his arse and hurt him bad for f***ing with her period.

                          I'm no judge or attorney but my expert legal advise would be that....

                          for attempted murder one has to actually attempt to murder another.
                          this was not the case. burgarly, breaking entering whatever they call it where you're at.

                          But if ya wanna play the good guy to get a piece of laura or Beth of whoever go ahead, you just might get your attempted murder charge.

                            I think you did it. You broke into her apartment... but since you're a gambler, you forgot what you're doing.. and started checking scores on her computer.

                            You got so involved in the game you were watching ... and you had porn on her computer... that you started to jack off while your team covered.

                            This explains everything.

                            So to sum up:

                            It was KEYBOARDING.... in the STUDY.... with the AXE.

                            Easy game of CLUE.
