And "The Prescription" is phony.
A gambler and tout who says he's a former psychiatrist and who runs an Internet website based on that premise never passed the medical boards to become a doctor, it was revealed in court last week.
Kenneth B. "Ken" Weitzner, 42, of Great Bridge, Va., who uses the online alias "The Shrink" and who runs a gambling-information website called "The Prescription," testified in U.S. District Court in Norfolk, Va., last week that he twice flunked the medical boards and never was certified as a psychiatrist.
The stunning admission came as pre-trial testimony continued in the $5 million libel lawsuit filed against Weitzner by English Sports Betting (ESB), a telephone sportsbook in Montego Bay, Jamaica, over comments Weitzner posted on his website.
On the website, which is located on the Internet at www.theprescription.com, Weitzner, originally from Woodmere, Long Island, N.Y., stated he is a former psychiatrist or "shrink" who uses his medical expertise when handicapping sports to gauge the emotions of athletes and teams.
In fact, the whole premise of Weitzner's website is that he, as a former shrink, is better qualified to assess the emotional levels of athletes and teams and therefore is a superior handicapper to his non-psychiatrist competitors.
The psychiatrist theme is carried on throughout the website, as Weitzner not only makes emotion-based selections on games but also displays an "insane asylum" in which he portrays straitjacketed caricatures of individuals he deems disreputable.
The website also consists of other touts' selections on games, a heavily-censored posting forum for public comments, a tedious weekly audio show hosted by Weitzner, plagiarized news articles about sports and gambling from mainstream media and pornographic photographs of women.
There are also numerous advertisements for offshore sportsbooks on the site--ads for which the sportsbooks pay Weitzner (ESB has never advertised there).
Late last year, "The Shrink" published false information on "The Prescription" that stated that ESB was in financial distress and might soon go out of business.
In response, ESB sued Weitzner for libel and also obtained a court order to immediately stop Weitzner from making any further false claims about ESB.
When Weitzner ignored the court order, the judge on Dec. 14 cited him for contempt of court, fined him $2,500 and made him--for the time being--shut down "The Prescription" and remove the website from the Internet.
As presiding Federal Judge Raymond A. Jackson once again looked on, pre-trial testimony continued Jan. 4 as ESB attorneys successfully attacked Weitzner's credibility by getting him to admit under oath that he is not and never has been certified as a psychiatrist or any other kind of doctor, contrary to the claims Weitzner has made on his website.
In addition to revealing he never passed the medical boards, Weitzner during cross-examination by ESB attorneys also admitted he had been arrested and convicted of falsifying medical documents, in connection with a previous attempt to misrepresent himself as a psychiatrist.
In other shocking developments, Weitzner also testified under oath that he:
*Has been arrested and convicted for drunken driving twice
*Has previously been sued and still owes a plaintiff an $11,000 judgment
*Still owes the U.S. government several hundred dollars for a 20-year-old student loan
*Has collected welfare disability payments from the government for years for a depression-related mental illness
*Receives regular credit counseling to help him deal with his debts and
*Has, as a sports handicapper, lost a lot more money betting on sports than he has won.
In addition, Weitzner provided evasive, "Clinton-like" answers to other questions asked him under oath, such as queries about his income (he claimed he doesn't know how much he makes) and his credit counseling (he claimed he doesn't know his credit counselor's name, even though he's been receiving counseling for a while).
By getting Weitzner to admit all this under oath, especially that he is neither a psychiatrist nor an ex-psychiatrist, which directly contradicts the claims on his website, ESB's attorneys proved that Weitzner lacks credibility and therefore what he publishes on his website also lacks credibility.
Further cross-examination of Weitzner by ESB attorneys is scheduled to continue this week.
Sources close to the case have told LVSN that as far as Weitzner's checkered past is concerned, only the tip of the iceberg has so far been exposed, and much more damaging information about "The Shrink" will come out as testimony continues
