I was agreeing with the warning that he should be aware when we weren't sure, then we started talking about why, which is the heavy punishment in a two party consent state.

The punishments are surprisingly (to some) severe.

In New Jersey, as long as sweep stays in New Jersey and doesn't plan to commit a crime with the info, then he's good.

As long as he is one of the people engaged in the conversation (i.e. his voice is on tape with the other people talking), he does not need permission from the other party(ies) to record. If he is not part of the conversation, he cannot record without at least one party to the conversation's consent.


One party consent basically means you cannot eavesdrop and record a conversation you are not involved in without permission by at least one person engaged in the conversation being recorded.

We contacted the SBR legal team and they were unsure, KVB a lawyer himself said it is only 1 party consent in NJ so technically Sweeper could of done it. The SBR legal team was still iffy on it.
