Here in California the mandatory minimum for such an offense is one year in prison, and very often at least two years. I don't care about the two years house arrest, the lifetime forfeiture of driving privileges, all that shit is nothing but a hill of beans. A family man was killed by a drunk driver, and he's getting 30 days in jail. Please, somebody tell me that this stinks to high heaven.

Doesn't effect your life or mine. No one should care unless A. You live in Miami. B. Your family member was killed by Stallworth. C. Your a family member of Stallworth D. You are Stallworth.

    End of discussion.

There was a lot more to this story than just that. The man was jaywalking in the middle of the night and stallworth had flashed his lights more than once to warn the man that traffic was coming. Stallworth never denied it, turned himself in, and was fully cooperative with prosecutors. I am by no means defending Stallworth but I think that the prosecutors office knew they didn't have a strong case and it was somewhat likely that he would have gotten off completely had it gone to trial....

Everything from politics to the courts these days is just an arbitrary crap shoot where the rules change while the dice are being thrown. It's the exciting game with no rules at all from the movie Bang The Drum Slowly where the idiot catcher played by Robert De niro was told to believe the game was on the level so he did believe it was.Look at the too big to fail bailouts and such. It's like all the people running this country are in a euphoric utopian dope buzz and if it's a good buzz they caught, you get favorable treatment,if it's a bad buzz they caught, you are a dead man.

THe family has discussed a "financial settlement" with him. No jail sentence will bring their family member back. Call me a douche, materialistic or whatever, but I'd much rather take the money and move on.

I just think it stinks that I got 7 months, served 13 weeks, for a DUI crash that did nothing more than destroy my Buick and fracture my fiancée's nose. And I understand that the victim was being careless, but I know I've crossed the street at night many times, absent a crosswalk, and were I to be run over by a drunk driver, I would be quite livid over the matter. Wasn't Stallworth also speeding? That's just plain recklessness, I've never exceeded the speed limit within city boundaries since my arrest and conviction.

It is my opinion that all jaywalkers crossing the street at 6:00 am wearing dark clothes are playing a game of russian roulette.

Entirely too harsh a sentence for my Nubian brutha. Just the white man at work once again.

Really? Mandatory Minimum of one year? Two words for you.....Vince Neil. Killed his passenger and messed up two people in another car for the rest of their lives and only did 30 days. Stop armchair lawyering and just deal with the fact that the laws aren't for everyone....just those of us who can't buy our freedom.

Don't know if true, but heard this side of it on radio. Civil settlement (money given to family by Donte) and family not wanting to go through the trial ordeal! Seems shady but this is 2009! The family chose money over Donte serving big time! I guess you can say it's a win-win situation! If it was the family's call, I respect their decision!

Put yourself in family's situation, man's life ain't coming back, Stallworth as stated previously on thread didn't run and was cooperative, so money was there to be received. Hopefully they aren't gamblers! Rich person does it, good lawyer works wonders, poor person does it, public defender gets him 5 years!

First of all how do we know this dude wasn't trying to commit suicide? I mean they showed the footage of his car parked on a highway after the accident and honestly all I'm thinking is, who the fvck walks across a highway at 6 a.m and doesn't look? Everyone knows from the age of about 3 to look both ways, he obviously didn't look both ways.

Or maybe he saw the big Bentley from a distance and decided to write himself a life insurance policy for his poor family by jumping in front of it.

Stallworth called the police when he did it, he cooperated fully, he never lied or tried to run, he took responsibility.

The family of the victim is happy with the outcome, and thats all that matters. Who are we to judge when all the parties involved are pleased with the outcome?

RS, there is still the matter of the ten year probabtion. One screw up of that and its off to serve the full sentence. And usually one of the terms is not to associate with other felons. So he won't be able to hang out with half the NFL.

And I guess never being able to drive again is pretty awful, I'd probably serve a year or two in the clink before I'd surrender my driving privileges for life. Sure, he can drive a boat or fly a plane, but that doesn't do you much good when you have to get a cab everytime you dock or land.

Average Joe would get a worse sentence.

Stallworth has money, lots of it. He can afford the best attorney, and he also paid off the family for the lose. First offense as well.....

...Money is the big word here.....

I couldn't agree more. I absolutely hate riding in a cab or having somebody else drive for me. I feel like a prisoner.

Even though one of the founding tenets of our great land is that we are a nation of law and not men, the reality has always been a far cry from the ideal.

At least in this case the extenuating circumstances considered, went beyond rich and famous.
