    Is there a statute of limitations on open containers and possesion of alcohol? Have been looking but havent saw anything about it

      both underrage, driver arrested on dui and passenger takes vehicle home after passing breathalizer. Both admit that the alcohol is the passengers but the officer lets the passenger drive the vehicle home

        Most misdemeanors have at LEAST a 2 year statute of limitations.

                    idk, just wondered if the officer would even bother with charging the passenger with anything if they let them go without arresting them to start with
