"Underground" games cater to the degen...not just in New York. Some allow players to play off credit. No legal place is going to allow for that. A bad player can get over his/her head pretty fast.

Players got carted directly to the courthouse at midnight and had the option to plead guilty to disorderly conduct, pay a $400 fine and be done with it or plead not guilty and face potential other charges. I got off on a technicality and just lost my table stakes and a 6 pack.
