guy should have maybe requested a blood test if he knew he was close to the limit, probably would have been around .06 by the time he was tested...although i dont know the state specific laws about refusing a breath test and requesting blood...also he might not want people having a sample of blood if there could be other incriminating evidence...he will be ok though, even "regular" people are not screwed when they blow .08, you just need a reasonable attorney.
