The Stevo vs SBR case update - Can a poster post a tout pick on a forum?

Can I ask a stupid question? I know, I know, no question is stupid... well 2 questions...

1. Is this the first of its kind in terms of a tout/service going after a site for posting paid picks, in this case SBR?

and secondly...

2. What if SBR never even offered their "Service Plays" section?
Would there even be a lawsuit? Wouldn't one would think, or at least the legal team for SBR prepare for something like this by offering the "Service Plays" section...

Is it really worth it? and What's the benefit?

2. Probably would not. Hindsight thingy there...

Lawsuits are part of the cost of doing business. In this case we are going to stand up for forums and all kinds of social media. If cases like this were to prevail it would severely limit the freedom to discuss matters amongst peers. We will prevail no matter how long or how much it costs.

I'd love to be in the jury box for a case like this IF all legalise jargon was replaced with SBR nomenclature and you'd get nuggets like this
