It was on the verge. That's what prompted the laws in 2015. It wasn't just some random shit they decided to do. There were proposals for a fast lane of content for companies who wanted to pay more. Plus, would you really trust the ISPs when they say they'll play fair - when most of us already only have 1 or 2 choices pending on the location?
